The Attorney General, Graham Leung, has raised serious doubts about his commitment to the rule of law with a naked attack on the independence of the Fiji Independent Commission Against Corruption, accusing it of a “witch-hunt” against its new Commissioner, Barbara Malimali, who was installed despite being the subject of a FICAC investigation herself.
Leung plays both sides of the fence in an astonishing display of disingenuousness. On the one hand, he says he has to be cautious about what he says because FICAC is “independent” and he could be investigated himself. Not now that you’ve got your own person running it, Doctor. And on the other hand, he launches into unprecedented criticism of the organisation under its now departed Deputy Commissioner, Francis Puleiwai, that calls into question Graham Leung’s own integrity as chief law officer of the State.
As the nation reels from an extraordinary day that began with Barbara Malimali being arrested and questioned by FICAC and ended with Francis Puleiwai’s resignation, here’s what the AG says in two adjacent and very different articles in today’s Fiji Times, the first of which is an astonishing attack on the independence of FICAC, describing it as “roguish” and saying that it requires a “reset”.
Then just below this extraordinary attack on FICAC, Graham Leung tries to pretend that it is still independent in a manner that will have the country’s lawyers and most other people falling about laughing or reaching for their sick bags in disgust.
Let’s get one thing straight, Fiji. This has been an outrageous and unrestrained assault on FICAC to remove its independence. It is no longer the Fiji Independent Commission Against Corruption but the Coalition Government’s Commission Against Corruption. And the real “rogues” aren’t Francis Puleiwai and her officers but the gruesome gaggle of Coalition ministers who have seized control of the organisation for their own purposes.
Principal among these is the Deputy Prime Minister and NFP leader, Biman Prasad, who has now escaped being charged by FICAC – an event that was meant to occur yesterday – and appears to have got away with his alleged wrongdoing in providing false information to the Elections Office about his assets and income before the last election. ( you can read the details on Victor Lal‘s Fijleaks).
But the most egregious public attacks on FICAC have come from those who are meant to uphold the rule of law – the double-talking Graham Leung and his predecessor as Attorney General, Siromi Turaga. And behind them, the rogue Acting Chief Justice and head of the Judicial Services Commission, the miserable Salesi Temo, who has long been a target in these columns for his successive breaches of the Constitution – the nation’s supreme law.
It is Temo who installed Barbara Malimali knowing that she was being investigated by FICAC for alleged abuse of office as Chair of the Electoral Commission ( see some of the evidence against her below). It is an unforgivable breach of all legal standards and conventions. And Temo, Leung and Turaga stand accused of betraying their oaths of office to uphold the Constitution and the independence of FICAC that is contained in the supreme law.
They have been aided and abetted by the likes of Manoa “Captain Kalavata” Kamikamica – another Dr Evil – who risibly claims in today’s Fiji Times that the Coalition is committed to the separation of powers and Barbara Malimali was chosen by two “celebrated judges” and chosen on merit. Yeah sure.
Let’s get another thing straight. Barbara Malimali is totally unfit for high office of any kind. As a strong and very vocal Coalition supporter, she staged a massive hissy fit on Facebook in the election aftermath demanding to know why Coalition supporters such as herself were not being chosen for government positions. This led to her obtaining her position on the Electoral Commission. And now she has been placed in charge of the Independent Commission Against Corruption when she is a Coalition stooge and there is nothing in the least bit independent about her. She is there to do its bidding.
Her first act as Commissioner, now that Francis Puleiwai has gone, will be to terminate the FICAC inquiry into her own conduct at the Electoral Commission. And her second act as Commissioner will be to block the investigation into Biman Prasad that was meant to have resulted in his arrest yesterday on charges of contravening the Political Parties Act. It is an obscenity that is rocking the establishment to the core. And it is so brazen that it has fired up the Fijian mainstream media into turning the blowtorch on the government in a manner that simply hasn’t happened before because public sentiment is now so inflamed.
Let’s get yet another thing straight. Barbara Malimali is a nasty piece of work. Aside from her grossly partisan support for the Coalition and her expectation of reward for that support, her record as a lawyer is highly dubious. In successive court appearances, she has been stridently argumentative and belligerent. And with an abrasive personal style, she is regarded extremely warily in most circles in “polite” society. Worse, she is a racist – someone who has been an overt supporter of indigenous supremacy at the expense of the minorities, which makes her totally unfit to hold an office of state that demands judgment, independence and excludes any form of bias or prejudice.
Barbara-gate – as the Fiji Sun is calling it – isn’t going to go away. The stench of what has happened on Fiji’s Day of Infamy – September 5, 2024 – has already enveloped and damaged the public reputations of Graham Leung, Salesi Temo, Siromi Turaga, Biman Prasad, Manoa Kamikamica and, of course, the Prime Minister, Sitiveni Rabuka. And the public anger isn’t going to go away, fuelled by the local mainstream media that has finally been jolted into recognising the corruption at the heart of this government. Say what you like about Aiyaz Sayed-Khaiyum but he would never have been this brazen.
The worm has well and truly turned – not least public disgust at the treatment of Francis Puleiwai and the character of the woman she was investigating but has now bested her and will run FICAC for the government’s benefit and as a vehicle to pursue and persecute its opponents.
This scandal will not be forgiven. And it will haunt those who have betrayed the public trust and degraded one of our most important institutions – the corruption watchdog – all the way to the next election.

From my observation he hardly covered himself in glory when he was the Solicitor general in the Cooks in a very shortened contract of 9 months. Underwhelming would be a kind way to put it. This is wishful and naive thinking. Bar a few – there isn’t much left in Fiji that is good – when you measure by a higher standard than Fiji standards.
Fiji’s leadership and pretty much everything else is comparable to Fiji’s medical system, private or public – broken and third world.
“Overseas” schools , universities, hospitals, rugby stadiums, Rugby Coaches and Refs, Water Supply etc etc are much better – as one would expect in a developed western country.
So how can Fijians expect their local leaders to be world class standard? In competency and ethics.
Expatriates are envied, hated and subject to a campaign of being sent home in favour of locals. Some expats do enjoy god like status, because they can shower money and expedite overseas opportunities.
So, suffer the locals that are on offer and favoured , except the hypocrisy of getting a foreign national Rugby coach when the nation wants to be world class!
Many of those who could have been good leaders are offshore, some are coming back more so as investors and entrepreneurs..some to invest for betterment of Fiji, most for self gain.

For the welfare of Fiji, put in an Interim Government, put the Constitutional Assembly in place. Change the representative system ie to a one party state.
The money we presently spend on elections , $60 million ?, be spent on building a one party structure through out the country, ground up. Give this system 16 years and then consider another system, by then corruption would have crept in. Cycle different systems, giving each 4 cycles, 16 years.
At least, if we do the job right, we will have a country with no idiots, aye. All engaged in, ongoing governance of our country, from our local district level all the way up to national level, all the while holding our representatives feet to the fire.

The natives will likely refuse the concept outright. Communalism, tribalism, provincialism, faith groups, bible thumpers will all together roundly deride the idea.
If itnwere to happen one party will impose their will on evryone with bad policies and the rest of it. We have plenty of examples of lawless behavior in government right now.

For instance, if it is job creation and industry ( Asian tigers focused on this after WW2 – jobs lead to all other advances) All programs and projects are prioritized on the basis of ROI ( return on investment) – agriculture, industry, roads , wharves, airports, education, health, town-district planning etc. in the hands of locals,
Specialists – engineers, economists, agriculturists, educators, health professionals, planners, etc, available to the people to be able to determine our priorities.
Meetings at lower levels are held at convenient times, for instance weekends, so that there is least disruption; allowing for all the people to participate. At higher levels, leave from work is mandatory for Congress level leaders.
Communications is both ways – up and down.
All government programs are part of awareness programs and available on line and
all policies are available for discussion and dialogue.
You should be getting the picture by now, please add to it.
Those leaders who stray from the agendas they hold in their hands, that have been formulated and agreed upon, will not survive. All leaders are servants of the people and have the job of implementing their resolutions, sitting down and prioritizing them with other leaders. There are no “want to be” politicians in this system.
We already have Sec 121 Transparency and Accountability Commission in the Constitution – which I envisage will have Guardian Councils in every District, to keep our Civil and Public Officers honest and to also keep our Representatives on the straight and narrow.

Its continuation from Kasavu to Loa, Buca Bay, 20 + kilometers, serving Buca Bay ( Tunaloa), Rabi and Kioa Island and Cakaudrove, Wainikeli and Vuna Districts in Taveuni. On the basis of ROI it would have the greatest priority in the North of Fiji, but alas, it is not to be, our PAP government I not going to deliver.

PAP has Speaker of the House Hon. Rt Naiqama Lalabalavu, Tui Cakau , Hon. Prime Minister Sitiveni Rabuka, Hon Minister of Heath Rt Atonio Lalabalavu and Hon Minster of Lands Filimone Vosarogo all living on or at the end of what should be a new sealed highway, yet this is not to be.
Why do they not consider their voters feelings and needs in this regard is incomprehensible, considering on the basis of ROI, it is justified, even without important Vanua considerations.
