# COMING SOON…THE LOOMING CHAOS IN THE JUDICIAL SYSTEM

Posted on August 13, 2024 27 Comments

A rogue Acting Chief Justice and the law of unintended consequences. How the Supreme Court decision to overturn the unlawful appointment of John Rabuku as Acting DPP now calls into question the legality of any case the ODPP prosecuted under his leadership.

The dominos are beginning to fall as lawyers around the country consider challenging court decisions that involved John Rabuku in the nine months he held the position of chief prosecutor from October 2023 to July 2024.

Hundreds of cases are now in doubt. And the buck stops with one man – the head of the Judicial Services Commission and Acting Chief Justice, Salesi Temo, whose violation of the Constitution in appointing Rabuku when he was ineligible to hold the position has triggered a potential catastrophe.

A judge should be independent, free from prejudice either racial, religious or gender based. This judge clearly does not meet those basic standards. It is a shame that people in Fiji are quiet about this because it serves their Christian racist agenda. It is not a good standard to set for the children. Because once low standards are set, people get used to it. Just ask why they cannot get rid of a dinosaur as PM even after 37 years. The people like the low standards he practices. And then they all complain a lot. Idiots.

It is obvious that a dickhead PM is making a lot of his flock happy. The chief dickhead will save his flock from progressing and they all love him for that. All the vulagi are oblivious. Remember these are special people we have here. In Australia we call mentally challenged people special people. There are lot of people in Fiji who are born speacial.

If there is a Christian agenda then why are they ok with being friends with atheist China? Because Fiji government is wishy washy as hell and cannot be clear or stand up for anything.

There is not one fearless person with integrity in this government who will take a stand against anyone or anything. I don’t call that freedom or democracy.

So much gratitude for stopping the last regime that Fijians allow just about anything while they put their faith and trust in one man. How long will the antics be allowed to go on and what will be the thing that is “ enough” .
I fear that by the time Fijians wake up and do something, the country will be no longer.

But China is Australia’s largest trading partner. Australa’s lobster farmers in Tasmania and coal miners in the Hunter Valley rely on China for their wealth. As for the sheep shaggers in Kiwiland, they have a free trade agreement with China. So whats the big deal with the Fiji PM going to China to carve out a niche for Fiji as well? Arent we (circumcised) Fijians able to do things ourselves?

With all the hoopla in the Olympics about athletes’ XY chromosomes that they previously tested positive for, and proclaiming their XX status, the acting CJ himself was a amateur boxer as a young man, and is actually masquerading as a learned judge when in reality he is a thug and a bully.

Fijians are a bunch of spiteful and arrogant racists. It is obvious that they do not like the vulagi population to do well through their hard work and financial acumen. And that too while the vulagi do not own much of the land. Even though the iTaukei own 94% of the land and make up more than 75% of the population they are spiteful of the progress of the vulagi. They think that the vulagi have stolen things from them. If they cannot progress like the vulagi than it is their duty to bring them down. That is exactly what is happening. Their predicament is all the vulagis fault. It is plain to see. The vulagi must not be allowed to progress any further. It is their Christian duty to bring the vulagi down and stop their progress and financial wellbeing. That is the wish of the vulagi God.

    He needs to be fired.
Illegally appointing someone when he knew too well what the consequences will be.
The State needs to understand that this is illegal at the highest level and Temo should be brought to face the consequences of this himself in court.
This is a bad bad bad look for Fiji.
Rabuku’s replacement needs to go too as she was hired by him – an illegal appointment.

The Supreme Court’s judgement was very clear. Was not qualified and therefore could not hold the position of DPP.

Santa Claus as many now prefer to call the A/CJ has no real choice. If he attempts to justify the actions of the illegally appointed A/DPP then he will acting contrary to the Supreme Court. If he agrees that the cases conducted by the A/DPP are void then his whole actions in appointing him were illegal.

What will he do? Given his alleged arrogance he will ignore the Supreme Court decision and justify the cases conducted, no doubt arguing that the magistrate’s and judged conducted the cases lawfully. With the illegal appointment being ignored!

Only in Fiji is this possible! Do I have confidence in the legal system of Fiji? Not any more!

The law of the jungle rules in Fiji. Only to suit whatever the narrative is at the time, then the full legal law is pulled in. Us Fijians are really too slack when it comes to holding our leaders to account. When it’s too difficult the race card is pulled.

About Grubsheet

Graham Davis
Grubsheet Feejee is the blogsite of Graham Davis, an award-winning journalist turned communications consultant who was the Fijian Government’s principal communications advisor for six years from 2012 to 2018 and continued to work on Fiji’s global climate and oceans campaign up until the end of the decade.

Fiji-born to missionary parents and a dual Fijian-Australian national, Graham spent four decades in the international media before returning to Fiji to work full time in 2012. He reported from many parts of the world for the BBC, ABC, SBS, the Nine and Seven Networks and Sky News and wrote for a range of newspapers and magazines in Australia, New Zealand and Fiji.

Graham launched Grubsheet Feejee in 2011 and suspended writing for it after the Fijian election of 2014, by which time he was working at the heart of government. But the website continued to attract hits as a background resource on events in Fiji in the transition back to parliamentary democracy.

Grubsheet relaunches in 2020 at one of the most critical times in Fijian history, with the nation reeling from the Covid-19 crisis and Frank Bainimarama’s government shouldering the twin burdens of incumbency and economic disintegration.

Grubsheet’s sole agenda is the national interest; the strengthening of Fiji’s ties with the democracies; upholding equal rights for all citizens; government that is genuinely transparent and free of corruption and nepotism; and upholding Fiji’s service to the world in climate and oceans advocacy and UN Peacekeeping.
