Proof conclusive that the former governing party in Fiji – the SDL – made a formal submission to the country’s Constitutional Commission is contained in a video clip of the proceedings posted on Youtube. The clip gives the lie to repeated denials by party officials that such a submission had been made and is a devastating blow to the SDL’s credibility.
The scene is the Suva Civic Centre last Friday. Two SDL members come to the microphone and within seconds, one of them declares: “This submission, on behalf of the SDL…” and then proceeds to outline the details. Repeatedly, the unidentified man says” “The SDL proposes..” as he advocates the adoption of a Christian state in Fiji, the adoption of Fijian as the national language, the term Fijian to be reserved for indigenous people, a ban of dual citizenship and the restoration of the Great Council of Chiefs and its power to appoint the president and vice president.
The repeated denials by the SDL leadership that such a submission came from the party are laid to waste by the video’s contents. The camera rarely, if ever, lies and their own lies have returned to haunt them. It may not have been the definitive SDL submission – which they say is still to come – but there is now no denying that this was an official SDL submission. It was cast that way by those who presented it, who did so in the presence of the party’s president, Solomone Naivalu. And it’s all there on tape. Undeniable, irrefutable and a total disaster for the SDL.
They’ve not only lied to the media in Fiji and overseas but they’ve lied to the country. They’ve also lied to the two political leaders with whom they were in earnest discussion about the way forward – Labour’s Mahendra Chaudhry and Mick Beddoes of the United Peoples Party. Chaudhry wisely refused to comment when he was asked about the SDL submission and what he thought about its advocacy of a Christian state. But Mick Beddoes went public saying he believed the SDL assurances that they hadn’t made a submission and didn’t believe those who maintained they had. Beddoes joined the SDL president, Naivalu, in singling out Grubsheet for special criticism, accusing us of getting the facts wrong. How embarrassed and enraged he must be to now find the egg firmly congealed on his own face.
The relationship between all three parties will never be the same. Why? Because quite apart from being lied to, neither Chaudhry nor Beddoes can ever go to the country in the 2014 election accepting, let alone advocating, the policies that the SDL laid out last week. It would be instant political suicide for both of them, but especially for Chaudhry among his largely Indo-Fijian constituents. Fully 40 per cent of Fiji citizens aren’t Christian at all. So the whole notion of imposing a Christian state on them is beyond all reason. It isn’t going to happen.
So at week’s end, the SDL leader, Laisenia Qarase, is in jail and his party has been shown up to be not only racist and bigoted but totally untrustworthy. It’s not a question of subtle interpretation either. There was a point blank denial from party headquarters that a submission had been made. It wasn’t even being “economical with the actualite”, as a British aristocratic MP once famously put it. In other words, only party true. No it was an outright lie, a clear intention to deceive. And the people of Fiji – the ordinary voters that the SDL needs to win over to ever sit in government again – won’t be forgetting anytime soon. Frank Bainimarama will make sure of that.
Let’s also see now what those who were gullible enough to take the SDL’s word have to say. Radio Australia, which twice reported “confusion” over whether a submission had been made and then ignored the story when the facts became clearer. The Indo-Fijian historian, Brij Lal, who said he couldn’t believe that the SDL would ever propose a Christian state because it was no longer the extremist party it once might have been. Plus all the SDL’s camp followers in Fiji and abroad, who slavishly support a discredited political party rooted in the country’s ugly past.
All week, the SDL could have laid the debate to rest by issuing a simple statement: “The SDL does not and will not advocate a Christian state in Fiji”. It refused to do so and engaged, instead, in the crudest of spin that even a freshly minted PR graduate from USP could have foreseen would eventually blow up in its face. For most people, that was enough to be convinced that what the SDL was so desperately trying to hide was, in fact, its true agenda.
Did the SDL – as some people think – fly a kite on the Christian state to see where the wind would take it? That if there wasn’t an outcry, it could become official policy and if there was, it could be modified or scrapped? Maybe but it’s a hell of a strange way to run a modern political party. Why lie in the first place when there were so many people in the room? Wasn’t it inevitable that the truth would surface? Well now it’s confirmed and beyond all reasonable doubt, as they say in the courts. Fiji for the i’Taukei and Christians and no-one else. As we said at the start of the week: “The longest suicide note in political history”. Amen.

For a Party that wants to Fiji to become a Christian State well, well should we not start by telling the “truth”? Or is it a case of getting some people whom no one hardly knows to present the so called SDL document under the guise that it is not an “SDL” presentation! Boy these two either lost their ‘qanibulu’s’ or a bunch of doce’s! They uttered the words SDL right from the word go and if Mr Naivula who was present at the presentation should at the very least inform the Commission that the presentation was not that of the SDL party! Quick to run to their mouthpiece in Australia (C4.5) & be critical of Graham! Now that the video is out Naivalu the SDL mouth piece is once again caught with his “pants down” (not something new for him) still defend themselves can’t they just simply state its their presentation! We start with a lie and expect God to sort out the crap we have accumulated afterwards! Nothing new is expected from the SDL , its a case of same old , same old -the smart SDL con artists have fled to Australia the ones left behind well JUDGE for yourself?? Tirigiligiligi all right!

SDL is now trying to bring NFP under its wing. NFP has always been a silent supporter of this racist politcal party. It was through NFP’s preferential votes that the SDL was able to get most seats in the parliament during 2001 and 2006 elections.
NFP was and is still just hell bent on seeing the demise and fall of FLP(which already is happening). They just can’t accept the fact that majority of Fijians of Indian decent have decided to support another political party.
Fiji wouldn’t have been in this mess if NFP hadn’t given their preference votes to SDL.

If anyone has been to one of the consultations you will see all the media there, its a transparent process. Ministry of Information are just as free as any media outlet to film. Prime Minister Commodore Voreqe Bainimarama has today revealed that he has spoken to the chairman of the Constitutional Commission Professor Yash Ghai a number of times stating that there are no restrictions on people making constitution submissions.
Professor Ghai has said that certain laws should be reviewed if they are not conducive to a free environment.
He said any restrictions on freedom of expression, freedom of the assembly and media freedom should be removed.
He also said it is not fair for the government to criticize any submissions from anyone including political parties and NGOs.
Professor Ghai said it should be a free process and every Fijian must be heard.
Professor Ghai said the laws need to be reviewed to ensure that there is a truly inclusive process.
Commodore Bainimarama said Professor Ghai knows there are no restrictions on submissions in the constitutional process.

“I’ve said that the commissioners need to get on with the job. They have a mandate from the people of Fiji. They should listen to the views of Fijians, collate the submissions and draft the constitution based on the submissions along the relevant decree and hand the draft constitution to His Excellency the President. They should get on with the job. The comments by the Chair are unfortunately misplaced. None of the laws. He has been told that time and again and the people of Fiji have heard about this. None of the laws currently in place stop any Fijian or hinder any Fijian from making any submission to the commission on any topic.”
Commodore Bainimarama also said it is clear that some people are trying to take over the process.
There is an audio file attached to this story. Please login to listen.
“What is happening is like a proverbial camel. They come in with their head into the tent and then their whole body comes in and they kick the owner of the tent out. That’s what him and the people they are listening to are trying to do. They are trying to get us back, bring back the old statements that they have been going on with for the last couple of months. The statement by the Chair also demonstrates the lack of fundamental understanding of our history, the influences at play that have for so long protected the elite of this country. On the contrary, the current laws provide for the safeguard of these unheard voices who have been marginalized to come forward and contribute.”
Commodore Bainimarama said Professor Ghai should know that the commission should be truly independent in its work.
There is an audio file attached to this story. Please login to listen.
“Comments that he is coming up with, I’ve heard that from people like Mick Beddoes, Shamima Ali and the trade unionists. I’d like to remind the Chair and the commission that at the swearing-in ceremony, the Chief Justice reminded the commissioners that they hold a quasi judicial position. This means amongst other things the commissioners should not be giving a running commentary on the proceedings. They should be completely independent. They should not give preferential treatment to certain segments or individuals in society who they meet privately and they should adhere to the laws in Fiji including the decrees that created the commission.”
The Prime Minister said he knows there have been a number of private meetings with certain individuals.
There is an audio file attached to this story. Please login to listen.
“They have been meeting privately with this group of politicians, NGOs and trade unionists who are pressuring him to come up with this statement and he should get away from that. I’ve told him a few times that he should get away from these private meetings. If they have anything to give to him in submissions, give it in the constitutional commission setting, not in private settings. That is the problem that we have here. He is pressured by these NGOs and politicians. These are the same group of people that want to have a hand in the composition of the Constituent Assembly so that they can pressure him into doing this and to changing what they want done and in the Constituent Assembly, have it cemented before they move into elections.”
Commodore Bainimarama stressed that he will not let these people having private meetings influence what is supposed to be done.

Graham Davis says
“Submission Observer”, I think you are being somewhat overwrought. Yes, there is obviously some tension between the government and Yash Ghai. But where on earth is the evidence that the process is going off the rails?
I personally don’t understand why the Constitutional Commission is having private meetings with certain groups in Fiji, as seems to be the case. Is this because of the public outcry over the SDL submissions? Are they worried about getting the same treatment?
If these groups really believe in democracy, they should be prepared to parade their views in the full glare of public discourse. It is not a good look to do it behind the scenes. And it’s not a good look for Yash Ghai and his commission to indulge them.
The notion that we all have to stand back and not say anything as the submissions are made is absurd. The SDL submissions are highly provocative in that they transcend the political and go to the heart of peoples’ religious beliefs. Calling for a Christian state is totally unacceptable in the Fiji context, a country with 40 per cent non Christians.
Let’s just imagine the flip side and what might have happened had the 1987 and 2000 coups not happened and Indo Fijians were now still the majority race. A Hindu extremist party takes office and uses the Hindu majority to enforce a Hindu state. Can you imagine the furore? And yet the SDL thinks nothing of unleashing something just as provocative on the current religious minorities.
The Government made it plain that there were certain non negotiable standards that the constitutional process had to meet. These are motherhood statements about the way a modern state should function. Deviate from them and we all have a right to protest.
Some people seem to think that we should all be incredibly civilised and sit in silence nodding indulgently when one of the biggest political parties in the country expounds religious and racial intolerance. No. They will be howled down in the court of public opinion, as they deserve to be.
Joeli Ditoka says
Mr Davis, I think you are missing the point. The idea is to get everyone’s view represented to the commission.
Then the constituent assembly will debate about what goes in and what stays out.
Yes we can express our views on the content of submissions, but our right to voice opinion is equal to their right to submit what they think is suitable.
Maybe we won’t agree with some of the things submitted, but that doesn’t detract from the right of those individuals or groups to make their submissions.
I found Prof. Ghai’s remarks on the Close Up Programme Sunday last quite interesting. Have you watched it? I missed the original screening then downloaded it yesterday.
Many are afraid of what they perceive as the strong reactions of his excellency the PM. I’m curious though, are there really private hearings? Are you referring to anything in particular?
Semisi says
The guys presenting the sdl submission on you tube are really party sapotas. One of them has a punk hairdo and the one reading seems to have difficulties in reading the txt. They must have been given cash to make the presentation and if something nasty happens sdl will deny and say they are sapotas. Smart but not smart enough.
Miss Information says
I agree with you all the submissions need to be done in the open and in public. They need to be discussed in the media.
However, the media need to be even in their coverage of the submissions. At the moment it seems to be in favour of Bainimarama by about 4:1 in terms of the coverage and that is not going to lead to the free and open discussions we need to reach a constitution that works for everyone in Fiji.
Private meetings may or may not be happening with Yash Ghai. But is it any wonder that people want to say things in private instead of publicly being attacked by Bainimarama. So far he has attacked the SDL, told women they are unimportant and mocked Chaudhry father and son who were held hostage for 2 months whilst he happily paid the wages and sent rations to the very people holding them hostage.
Bainimarama has made it clear that the constituent assembly is going to be made up of people who think like him. I would have thought that the Pacific’s Woman of the year in 2011, Shamima Ali would be just the sort of person to have in the Assembly but we are told by Bainimarama ‘The Constituent Assembly will be made up of credible people who think positively about Fiji’s future and he said and I quote “tell Shamima Ali from me she is not in that league” end quote.’
Again that position makes it clear that the end result will not be independent of the dictator.

John John says
Yash Ghai should disclose exactly.who has been given a private audience with him, whether the whole Commission was present, and if it was with him alone, why that was the case. Why should some people be forced to give public submissions and run the risk of condemnation when others like Shamima get preferential treatment?

A right-wing Hindu Party by the name of BJP (Bharatya Janata Party) truled India which is the largest democracy in the world, and nothing happened to the minorities – anyway, you should concentrate on learning Fiji Hindi if you are so passionate about our rights – by the way Frank’s non-racial Fiji is unraveling as he is attacking the very Indo-Fijians he claims he is trying to give equality.

You are drawing a very long bow my friend.
It is all part of the current political banter. Indo-Fijian rights will not be taken away from them. We have come too far down the ‘equality’ track to now turn around and go back.

Hindu Admirer,
What happens in India is of no relevance to the debate and discussion on what is happening in Fiji. However, it can be said that the history of BJP is littered with inflammatory rhetoric regarding muslims leading to violence against them (with retaliation and counter retaliation). I am quite happy to list incidences during their rule which demonstrates this but space (and time) here may be a problem.
There is no reason for Graham and others who provide comments here to learn “Fiji Hindi” for him (or them) to be passionate about the causes of justice, tolerance and acceptance and to raise issues for us to ponder, debate, argue and comment on.
It would be useful to ponder on the notion of “our rights” mentioned in your posting because I for one would have some difficulty in coming up with a set of basic rights which would be different from a set of basic rights demanded by other groups. And I think that this highlights the centrality of the mindsets of groups of communities within Fiji which needs to be changed. And Fijians of Indian origin (not necessarily all but a fair few) are just as culpable in having a mindset that needed changing from (among other things) this concept of “our rights” v “their rights”. Having been raised in a Hindu family and in that community I was, and continue to be, acutely aware of the need for that change within that community for the good of the country as a whole.
Yes, and as Graham has pointed out in many postings, the Bainimarama Government has erred in some things that it has done and some things could have been done differently but as things stand it is taking Fiji in, at least my view, the right direction. Whether that ultimate goal is achieved will depend not just on the government of the day but on the steps taken by each individual in Fiji to overcome their respective prejudices and fears.
At this stage I don’t see any concrete evidence of an unraveling of the Bainimarama Government’s united Fiji vision. It is still a work in progress because there is no magic wand that brings about an instant change to the values, the way of thinking and the way of life inculcated in people and in communities (yes, including the Fijian community of Indian origin) over many generations.

Graham Davis says
Hindu Admirer, shades of the Stockholm Syndrome, that you’re so used – as an Indo Fijian – to being discriminated against that you start identifying with your oppressors?
This is all about equality of opportunity for all. The PM isn’t perfect and doesn’t claim to be. But what he seems determined to do is to give every Fijian child, irrespective of race, the same opportunity to get on in life as the next.
The Bainimarama vision is not just a Fiji for Methodist, i’taukei speaking, heterosexuals who like being ruled by hereditary chiefs. It’s for them too but everyone else as well. Hindu, Muslim, Sikh, Buddhist, agnostic, atheist. Gay men, lesbians, everyone.
People’s religious beliefs are private matters. They’re not to be enshrined in the state, for one religion in a multi-faith country to “Lord” it over the rest. This is the SDL’s blind spot and what makes it unfit to govern a multiracial, multi-faith and, yes, multi-sexual society.
How can you as an Indo-Fijian possibly support their program? It essentially strips you of existing rights and entitlements? How can someone like Mick Beddoes support it either? I’m genuinely interested in hearing more from you on this.
Hindu Admirer says
You chaps are sick and inverse racists – Indo-Fijians on this site – believe me, sooner the Fijians will rise up and the likes of you will be begging for Australia, New Zealand, US and India to intervene – it is the likes of you and your thoughts that made some Fijians who they are today – give me statistics to prove your claims that Indo-Fijians are suffering in Fiji? And stop bring land leases please!
Graham Davis says
OK, so you seem to be concerned about provoking the i’Taukei. They are not under any threat whatsoever so there is no cause for them to be unhappy or rebel. But rest assured that any uprising in Fiji against the other races will be crushed. That is the RFMF’s solemn promise and there is no reason to disbelieve it.
It is what is keeping the peace now and will continue to do so in the future, democracy or no democracy. The biggest human right of all is for every citizen to be able to sleep safely in their beds at night. And if it takes a dictatorship to ensure it, that is the system of government Fiji will have.
Now, we all hope that common sense prevails and that we can forge a national identity that is inclusive, gives everyone a sense of belonging and provides the investment and jobs needed for Fiji to thrive. That is already happening and we hope it can also happen under democracy when it returns.
The cancer of divisiveness in Fiji must be removed. Whether it’s at the point of a gun or at the ballot box is the choice the nation now faces. That’s why this process is so important and why the divisive policies of the SDL are simply unacceptable.
Chand says

The Police know who he leader is at that minibus station in Nausori. That leader was ex military who was rounded up at parliament house in 2000 and is from same village as Sami.
Those who view the YouTube clip will see him constantly glancing around in his ‘bodyguard’ mode. He had no idea what was being read by the other fellow from Vuci who had trouble reading his script.
When we saw Sami in the clip we laughed our heads off. Oilei o Sami na tamata dau via va’teratera (person who likes to show off that he is a tough person).
Sami is a dickhead and was probably looking around coz he was scared shit that ‘Team Zulu’ from QEB would turn up and make him swim across the Rewa River three or four times, plus another one under the bridge just coz Hibiscus Festival coming up next week.
if the SDL really wanted to impress then they should have got some better people to present their submission. At least a shirt and tie and fluency in English presentation would have helped their cause.
But they let Sami ‘bodyguard’ in with a bush T Shirt and jelly plaits and all. Very unFijian.

He is a very simple person and as you had stated, like any young fijian man, once the elders are around, he will serve their yaqona (veiqaravi) even though as i understand, he is at the SDL Party Office doing special projects. He is always humble in giving his opinion on any IT subject but mind you he had undertaken sophisticated IT projects successfully (eg Turtle Island, Laucala Island) You ask his IT acquaintances and you will be surprised how much reverence and respect they hold for this man. As far as i am concerned, he is a cut over Jale Baba in election strategics. Malo Tovata. Malo a Bula.

Fire Viti, i know this Mosese very well. He had never claimed that he had graduated and he always humbly admits that he has yet to graduated. You will never hear him calling himself an expert either but you will know he is an exceptional cut when you hear that even experts call him for his opinions and assistance on sophisticated projects. As you suggested, I have actually called both companies and mind you they both spoke highly of this man. He was never terminated but actually accomplished his work successfully.
Fire Viti, its obvious that you hold personal grudges and it is quite obvious to me, you sound like you have a serious case of sour grapes.

Thank you for the video upload. Can you also upload the complete part of the submission by the second presenter? Thank you.

HIndhu admirer BJP or SDL or SVT or NFP if they are racists they are it -so whats the fuss, even if they live in Astralia , NZ or Fiji. Racism doesn’t have any boundries but that would be difficult for you to figure out seening that whats been attempted now more than ever is the unifying of the peoples of Fiji to be one, yes we maybe diffirent in colour , beliefs, racial makeup (humans we all are) but in those differences we are unique, unless you have another way of attemtping it? If you think it could be the ballot box, constitution etc you need to think again-you have to change the MINDSET!
Thats the name of the game-thats what Moses attempted to do to those that fled from Egypt, change the thinking for the good of all not just a few!

Can you please upload the part of the submission where they addressed immunity for the coup perpetrators and the name “Fijian” to be indigenous Fijians only. I understand there is another second part of the submission apart from this first presenter. Can you also upload that part as well?
Graham Davis says
Sorry “Sisa Mana”, I can only provide a link to what has already been uploaded on Youtube. I don’t have my own source for the material.

Thats fine. Thanks Graham.

Yadra, hey Gram do all this people know that the FDM Movement in Australia were visited by Pio Tikoduadua when they were having their meeting with the inclusion of Ro Temumu Kepa and she suddely left When Pio tell them straight of whats happening in Fiji.None of them spoke as they just bow down including JB and Suli Daunitutu who was straightly pointed out to come back to the village and see for himself what the present gov is doing at the moment.Vakamadua tale ni ra sa tobo mamaca tu………..
Graham Davis says
Yes “Fijiana”, I have heard sketchy reports of Pio Tikoduadua’s visit to Australia and am trying to find out more. Very intriguing. Has anyone else got anymore information on this?
Anonoymous says
I heard that Pio came to Oz courtsey of the Oz government who are wanting to repair their relationship with Fiji. It was a ‘low key’ visit. Pio was in Sydney and Canberra. He fronted up to the democracy mob in Canberra who were shocked to see him appear at Suli’s door with his ‘sevusevu’.
My contacts in Canberra say that Suli was unable to engage in a meaningful conversation with Pio as he kept mumbling incoherently about Fiji, looking at the floor and scratching the mat in avoiding eye contact with Pio. He was a man cornered…a coward finally meeting the person he had abused so openly on his blogs about the need to return Fiji to democracy.
What a bunch of cowardly wankers these pro-democracy mob are – led by Suli Dauniveidulu in Oz with the backing of Jonetani Baleidrokadrola, Brij Lal and John Fraenkel and of course, that now irrelevant tevita Mara in Tonga.
Anonoymous says
I was also told that Pio was escorted to the Democracy mob meeting place in Canberra by a Police patrol car and another unmarked vehicle with men in dark glasses, trenchcoats and earphones etc. One of the Oz ‘coppers’ was Fijian!
Ya, what does that tell you?
Tomu says
Fijiana
Vinaka, thats what the RTD has been doing, soliciting support f5om those losers in Aussie and USA. Adi Lala Mara must be rolling in her grave to see her successor cavorting around with all these losers.

This is a desperate attempt by Kumar to save the pathetic FLP by by diverting attention away from the party and its leader’s pathetic and miserable failures. Kumar is the typical blind FLP supporter who has no sense of reality.
It is the alleged tax-dodger and embezzler of Aust$2.5 million funds, one mahen chaudhry, who is desperately courting Qarase. This has been well-publicised, so where are you coming from Kumar? Who are you trying to fool? it is well known mahen is an unprincipled man who will do anything, including open toilet doors and sleep with ethno-nationalists, to get into power.
Your leader mahen has totally destroyed the FLP through nepotism and dishonest practices by appointing son rajen to govt job and in-law Sachida, a hopeless performer, to the senate against party directive .
FLP is full of old farts and castrated bulls who who get urinary incontinence and lose control of their bowels when mahen or mahen jnr raise their voices. father and son totally rule the party over a bunch of useless and spineless FLP executives.
party names used to raise $2.5m for greedy chaudhry family coffers.
FLP represents the chaudhry family, not the poor workers of Fiji who support FLP, from whom mahen took away $2.5m. Kumar.
Your pathetic attempt to drag NFP into the FLP kichar (sewerage pit) will not work.
KUMAR says
I admit FLP and its leader made mistakes.
But can you admit that NFP has also made mistakes.
Indo-Fijian says
Whatever mistakes the NFP may have made, their leader did not go around the world with begging bowl in hand like a bhikari asking for money supposedly for the poor and banking it in family account. You FLP supporters who follow mahen blindly should hide your faces in shame.
Whatever mistakes the NFP made, it paid for it at the polls. Now it is FLP’s turn.
varanitabua says
Fijiana thats suprising because i was talking to an FDM supporter just the other evening and he never even mentioned what you have just written. Suprising also is no mention of the visit on C4.5-should one be suprised??? Tobo na nodra lawaki!

The same con lawyer Mosese Vosarogo who is on trial with master trickster Ben Padarath?
Waisale says
Tevita, you probably referring to Aseri Vakaloloma, the lawyer that was tricked by Ben Padarath. Aseri Vakaloloma is a decent and well respected lawyer so you better just be a bit fair to him here. The nature of their case is yet to be judged by the magistrate judge ofcourse.

Lets not get away from the focal point of this additionn from our Graham Davis, …the smoking gun. My mate, my gang, is it all still relevant? Looking at the youngsters parading around the Hibiscus Festival I think not. I doubt very much they know anything about the smoking gun and conditions surrounding the smoking gun. Important as it is to us, what about them? Do they see the smoking gun and can they see where the smoke is coming from?
