We now have the formal judgment from the Chief Justice, Salesi Temo, explaining his reasons for again denying the former attorney general permission to travel overseas for urgent medical treatment. And it is a shocking indictment of the judiciary in Fiji that someone who is so blatantly biased and ignorant can sit at its pinnacle.
Salesi Temo raised eyebrows in the previous hearing of Aiyaz Sayed-Khaiyum’s application when he played doctor and advised him to seek treatment at Nadi’s Heart International – Fiji’s only specialised cardiac hospital – which he praised as having a good record of treating cardiac complaints.
As it happens, the former AG had already done so. And the following is what the specialists at Heart International had submitted to the Court:

As Grubsheet revealed on Wednesday, this recommendation was supported by the following three specialists at the Aspen Hospital in Lautoka, where Aiyaz Sayed-Khaiyum has been treated for a stroke and ongoing cardiac problems.

And from the following specialist from the HealthMasters Medical Centre in Nadi, which has long been treating Aiyaz Sayed Khaiyum and members of his family.

That’s six specialists in the private sector with intimate knowledge of Aiyaz Sayed-Khaiyum’s condition. Yet in ignoring their recommendations that the former AG be allowed to travel, the Chief Justice chose instead to heed a report from three doctors in the Ministry of Health who haven’t examined him – one of them an ophthalmologist, an eye specialist – that his afflictions can be treated locally.
That’s right, Fiji, six to three in favour of Khaiyum being able to go overseas because he can’t be treated locally. No, make that six to two. Because what would an ophthalmologist know about heart conditions and strokes? Undoubtedly more than “Dr Temo” but not much more.
Yet not content with turning his back on expert opinion, the Chief Justice has done something even more extraordinary. He criticises the six experts who provided him with an opinion he didn’t like for the quality of their reports.

Incredibly, they “leave a lot to be desired” because Salesi Temo says he had trouble understanding them. They are totally unambiguous in saying that Aiyaz Sayed-Khaiyum requires urgent treatment overseas. But that’s not good enough for “Dr Temo”, who occupies the top job in Fiji’s judiciary but can’t comprehend documents in front of him that explain the bleeding obvious.
It confirms what many in the criminal justice system have long observed – that the Chief Justice is intellectually challenged and struggles to master issues even when they are explained to him in simple terms.
Another explanation, of course, is that he simply doesn’t want to understand because it doesn’t suit his purposes and prejudices. Yet whatever the reason, this is a man who has again demonstrated that he is totally unfit to preside over the judicial system. This is quite apart from the finding against him by the Supreme Court Commission of Inquiry alleging perjury and obstructing and perverting the course of justice in the Malimali affair.
But it gets worse. Because in his latest ruling, “Dr Temo” continues to dispense medical advice from the bench, actually prescribing which doctors he is willing to listen to and which doctors he won’t.

There’s only one problem with this and it is as glaring as it gets. According to other experts, Dr Sanjeev Khulbey is a cardiothoracic surgeon who performs heart operations such as inserting stents and mechanical valves. But he is NOT a cardiologist with the specialised expertise Aiyaz Sayed-Khaiyum requires – treatment for his irregular heart rhythm that can ONLY BE OBTAINED OVERSEAS because the capability DOESN’T EXIST in Fiji. It’s all in the documents we published on Wednesday.

In my opinion, the “judgment” is poorly drafted, and a first year law student could have produced a far better written piece of work. The judgment is so one-sided and he expresses his personal bias and not as an impartial jurist. His role of the Chief Justice is a disgrace.
Meanwhile, my advice is that “two can play this game”! Therefore, I suggest that, a day before the schedule court Hearing date, ASK should present himself at the local hospital complaining of chest pain. No doubt he will likely be admitted because of his previous medical condiion for further investigation as an inpatient. As a result of his admission the Hearing can’t take place. That would throw a “spanner in the workshop” because the schedule Hearing will be adjourned thus causing a headache and mountains of inconvenience to the corrupt judiciary. Then the whole saga goes back to square one.
That would teach those buggers a lesson!

This case has been going on for far too long.
Almost 2 years in magistrates court, and now into high court.
One bail variations after another for sometime now.
Get this bloody case disposed off quickly and Ayaz can either become free to travel anywhere or locked up if he doesn’t pull through hos case.

There should be some speed in justice system, so that victims innocent and criminals get quicker trial and judgements.

Fiji’s judiciary are tainted as a result of the findings made in the recent CoI Report. Justice Temo, together with the people from the Office of Prosecution as well as the Solicitor-General were identified and implicated in that Report as persons of interest with a view to them being investigated further for alleged criminal acts.
Now, these same people are involved in administering Fiji’s corrupt justice system despite a cloud hanging over them. Meanwhile, their own judicial positions are under public scrutiny. And, now you are suggesting that the same corrupt people should be sitting in judgement and dispensing with justice?

This case has been going on for about 2 years because apart from asking for bail variation to treat a serious health condition which he has granted and and came back from the incompetent DPP has been picking around with the case. The stupid dpp couldn’t make up their minds whether to charge both saneem and aiyaz individually or jointly. They dragged this issue on for a while and then decided that they wanted a high court trial. This prolonged the case even more. Musical chairs with magistrates were played by the head of the judiciary by way of Temo the clown. All this had nothing to do with Aiyaz. In the meantime Aiyaz made applications for another medical urgent review as stipulated by his doctors in Singapore. Each time he got knocked back for frivolous reasons and in their desperation the dpp even got the police to presebt a forged document and in court which alleged that Aiyaz was a Bangladeshi resident and that he would skip to Bangladesh on the pretence of going to Singapore to see his doctors. Of course the compromised magistrate did not address the forged document issue with the police and neither did the media report this absurdly stupid Bangladeshi citizen claim. The police also claimed in court that they had been ‘told” that he had property in Australia. But when quizzed by Aiyazs lawyers they couldn’t tell where in Australia his property was! The dpp and the police have lied so much in court that the police have the trembling lips syndrome every time they have been asked questions in the dock. If the courts had allowed aiyaz to travel then the trial could have started by now and most importantly Aiyaz would have been in a better state of health to have gone through the trial which is his constitutional right. Of course you lot dont give a f**k about tbe rule of law and the constitution. But when I started to criticise the new government after the election, they cut me loose. I realised then that none of them genuinely had the national interest at heart. Because if they did, they could tolerate contrary opinion and especially when it was deserved. For them, it was all about gaining an advantage under the “new order”.
Pramesh Sharma is the worst – actively undermining the Supreme Court Commission of inquiry because it affects the positions of those he wants to impress and being a prominent cheerleader for the criminals operating at the heart of government. They will all have their day. He says “karma is for real and karma can be a hungry bitch”. But not as real or as hungry as the judgment of the people when the true agenda of these masi polo opportunists and the extent of their betrayal is exposed and they eventually get what is coming to them.
Whether Aiyaz Sayed-Khaiyum’s condition warrants urgent treatment overseas isn’t about politics. It is about common decency. Even if he refuses to return to Fiji, justice will still be served. There can be extradition proceedings and he will live in permanent fear of being detained and returned to Fiji to face additional punishment. But for the moment, six of the country’s foremost heart specialists say his life is in danger.And how we respond to that defines as as a nation and a people.
I salute Professor Wadan Narsey for saying in Sunday’s Weekend Times that ASK should be allowed to go. With 31 years of experience, CJ Temo wrote only 18 paragraphs with virtually no analysis of the facts or law regarding this application by Khaiyum. Most of the 18 paragraphs contain the timeline of whats happened. Where exactly in the affidavit or medical report did Temo figure out that the medical issue can be resolved within Fiji. But the ego within him attacks medical report’s?
The Fijian bench write lazy judgements or decisions. One look at the quality of writing done by the bench in Australia or NZ shows Fijian tax payers deserve better.

It is sickening and shocking to hear itaukei talk about their own fellow citizens.
Totally dissapointing that we have a lot of my people who have prejudices against other groups despite professing that they are believers of Christ.

Somebody should lodge a complaint against that Eye Doctor Dr. Luisa who was a failed Medical Superintendent of Lautoka Hospital which run that hospital down which led to the Lautoka Hospital to be privatised.
Somebody should lodge a complaint with FMDC on those 3 government stooges who testified beyond their expertise despite 6 cardiologists including a Singapore cardiologists saying otherwise.

Well Christianity does have impact on itaukei people.
After FFP lost election, Aiyaz became a normal citizen as anyone like us.
No armed body guards, no police escorts,
No road closure.
No sirens.
Aiyaz is walking free on streets.
No one has physically harmed him or abused him in public.
There were always hate for Aiyaz but no hard feelings.
He is free to walk on the streets of Fiji.
There is great understanding within the itaukei community.

As an itaukei the words that come forth from the mouth exhibits what is in the soul and spirit of a person, unfortunately is clear understanding of the hate in the itaukei soul and spirit.
The hate and vitriol that comes from the mouth of my fellow itaukei is hate for their fellow Fijian Citizens.
There are serious concerns regarding the impartiality of the Chief Justice of Fiji. He has been named in a Commission of Inquiry report that recommended his suspension. Despite being cleared by a panel of three Supreme Court judges, Christopher Pryde was again targeted by the Chief Justice, who advised the President to suspend him.
Additionally, the Chief Justice overturned a lower court’s decision by sentencing Frank Bainimarama and Sitiveni Qiliho to prison, even though the magistrate had issued suspended sentences.
More troubling is the fact that the Chief Justice appears intent on presiding over cases involving Aiyaz Sayed-Khaiyum, Shameem, Bainimarama, and Qiliho—raising concerns about a potential personal vendetta. The law says that everyone is innocent until proven guility.
I’m upset at the fact that Viliame and Ruci Gavoka have done absolutely nothing to assist their son in law, daughter and their grandchildren. What kind of grandparents are they? What kind of parents are they? Reminds me of Viliame once saying to Aiyaz in Parliament “All is Fair in Politics”. What kind of political games are the Gavokas playing?
For those bleating on and on about Karma, they should be aware then that they themselves who want to crucify someone without so much as evidence but their own hatred, prejudice and general savagery, would also suffer the same karma.
