The Assistant DPP, Laisani Tabuakuro, is insolent, intemperate and has no idea how to behave. She simply shouldn’t be there. And her presence in the job – if it isn’t strictly unlawful – contravenes all accepted practice in the civil service and offices of state and all employment practices.
Tabuakoro was removed by the substantive DPP, Christopher Pryde, when he was reinstated back in January but then rehired by the Acting DPP, Nancy Tikoisuva, without any reference to Christopher Pryde or any official announcement when Pryde was again sidelined by the rogue Chief Justice, Salesi Temo.
That was on trumped up charges of expenses rorts from the same file that three High Court judges had considered and rejected when they exonerated Christopher Pryde of misbehaviour and the President, Ratu Naiqama Lalabalavu, ordered his reinstatement.
Just as Christopher Pryde was about to return to Suva, Nancy Tikoisuva again lodged a formal complaint against him with the Chief Justice alleging misbehaviour. Four months later, Salesi Temo – who falsely described Pryde as thief during the proceedings at which he was acquitted – still hasn’t made a decision on whether to suspend the DPP or dismiss the charges, as the Constitution prescribes, and Christopher Pryde continues to wait offshore for a decision as Nancy Tikoisuva occupies his office at Gunu House.
At the same time, Tikoisuva lodged a complaint against Pryde with her close friend, Barbara Malimali – who has now been sacked as FICAC Commissioner – with the same trumped-up evidence. Naturally fearing arrest if he returns to Fiji and a stop departure order that would prevent him from leaving, Pryde is declining to return to Suva until Salesi Temo tells him whether he is going to be suspended again and face the ordeal of yet another Tribunal hearing. But Temo is stalling because he knows that a fresh judicial hearing will, in all likelihood, produce the same result as the last. Exoneration and reinstatement.
In the meantime, Temo has informed Pryde that the Judicial Services Commission won’t make a decision until FICAC proceeds with its case aganst the DPP. It is in direct contravention of the Constitution and is simply the latest instance of the Chief Justice thumbing his nose at the supreme law. But it is keeping Christopher Pyde away from Fiji and that suits everyone but him just fine. Nancy stays in the job of Acting DPP and the months tick by while the taxpayer pays for two DPPs – the substantive one and the acting one.
It is yet another reason why Salesi Temo is unfit to be Chief Justice and should be removed as quickly as possible. And so should Nancy Tikoisuva and her Deputy DPP, John Rabuku, all three of whom have reportedly received adverse findings in the Ashton-Lewis Commission of Inquiry Report into Barbara Malimali’s appointment at FICAC.
At least Nancy and John have the sense to keep their heads down. But not so the headstrong and arguably unhinged Assistant DPP, Laisani Tabuakuro. When Christopher Pryde’s return to Fiji was thwarted, Tabuakuro taunted the DPP on social media and in internal emails within the ODPP daring him to come back and face being charged by FICAC on Tikoisuva’s trumped-up charges.
It was insubordination of the worst kind – a relatively minor prosecutor in the ODPP publicly waging war on her boss when three High Court judges headed by Justice Anare Tuilevuka had exonerated Pryde and he had been formally reinstated as DPP by the President. It is, in fact, unprecedented in the annals of the civil service and offices of state. Yet it is the clearest possible sign of the arrogance of the current corrupt clique in the ODPP and especially of Laisani Tabuakuro, who has already broken all the rules of proper conduct.
She behaved with petulance and insubordination at the original trials of Frank Bainimarama and Sitiveni Qiliho. She openly criticised the Fiji Labour Party on social media in direct contravention of ODPP rules that staff remain above politics. And her taunts and threats against Christopher Pryde – her boss and one of the most senior officers of state – are an extraordinary breach of employment policies that would be not be accepted anywhere else in the world but Fiji.
When he was reinstated, the DPP made the decision not to extend Laisani Tabuakuro’s period of probation as an assistant DPP. Yes, incredibly she had done all of this without even being confirmed on the permanent staff. Yet equally incredibly, as soon as Christopher Pryde was again out of the way and Nancy Tikoisuva was back in charge, she brought Laisani Tabuakuro back and gave her a permanent contract. Yes, removed by the substantive DPP one week on completely legitimate grounds and then reinstated by the Acting DPP soon afterwards.
Along with Nancy Tikoisuva’s drunken antics at the last DPP’s conference, her conduct towards Christopher Pryde and her countermanding of his decision when Tabuakuro was so completely out of line, makes her totally unfit to head the principal prosecution service in Fiji. But there we have it in the corrupt system that Salesi Temo has engineered as Chief Justice and head of the JSC.
It was, of course, only a matter of time before Laisani Tabuakuro offended again or she became an issue in court proceedings. And it has now happened with the fresh trials of Frank Bainimarama and Sitiveni Qiliho in the Rusiate Tudravu matter. Their Counsel, the doyen of the Suva bar, Devanesh Sharma, has made an application for Laisani Tabuakuro to recuse herself because of her history of bias and true to form, she has petulantly refused to do so.
The Magistrate will rule on the matter in due course. Yet by any standard, Laisani Tabuakuro is unfit to conduct the prosecution and must not only be recused. She must be removed from the ODPP because she poses a clear and present danger not only to fair trials in the current proceedings but to the proper conduct of the criminal justice system and the administration of the rule of law in Fiji.

Temo has all the judges and magistrates under his thumb like a thug. They have all been threatened that they should toe his line. We know this. You just have to look at the decisions they are giving out but more importantly the rationale. See the conduct of the DPP staff from nancy to rabuku to laisani. They lie in Court, they tell off the magistrates, they essentially bullshit their way through, personalise matters. When they mention judges in their verbal submissions they simply take their names rather than saying Honourable. All of this is happening because of Temo. He has their backs.
While some of us have to adhere to all standards and get told off by magistrates at a drop of a hat or even will be reported to LPU. Temo has given specific directives to those on the judiciary especially in relation to JVB and ASK and those who are seen to be linked to them. Some of us lawyers and journalists are actually disgusted by what is happening in these court apperances. The other day laisani who pryde had fired and is back courtesy of Nancy and Rabuku, started a personal attack on Devenesh Sharma. The Magistrates don’t pull these people up on their unruly and unprofessional behaviour. We heard that in Nadi some weeks ago laisani attacked personally the Australian barrister, appearing for Fiji Airways. Why do they do this because they have become thugs like daddy thug Temo.
Also amazing to see how people like magistrate yogesh prasad and judge Daniel Goundar just to keep their jobs or fear of falling out of favour with Temo, masi polo Temo in such an embarrassing manner. Rather disgusting. For us lawyers these people are not fillowing the standards of law we expect. They are following their daddy temo, who also does not follow established precedent. All of these people are shameful. They have no dignity and frankly people laugh at them behind their backs. Unfortuantely though because of this corruption, big fish like Temo will screw our country and make it a laughing stock. People like Richard, I love myself naidu, won’t blink an eye lid because it serves their purpose. So much for portraying themselves as upholders of rule of law. Btw his law firm Munro Leys now does all the legal work for almost all of the big government owned or related organisations. No tenders. The NZ High commissioner has been the hand behind many of these maneuvering. She has gone all tropical. She is the one bringing in all these kiwi judges who are changing our jurisprudence and contradicting themselves. She has cocktails at her residence and calls all of the above to influence and boy do they sing from the same songsheet.Why do you think some of these decisions are being made.
Anyway Temo should go, Pryde should be brought back, Aslam the former ficac head should be brought back and one of the sitting judges who was not appointed during this government and who actually believes in the real independence of the judiciary and wont act like a thug and leave the magistrates and judges alone should be made the cj.
This is so true. There is a growing trend among some within DPPs office to use a Magistrate’s first name rather than addressing properly.
This has been an ongoing situation from Bai/Kai’s reign, regarding such eager-beavers “lave-liga, compliant and compromised” members of the bench.

Tabuakuro will not be recusing herself. Unfortunately, her pig-headed mentality and lack of any professional decorum prevents her from seeing how conflicted her involvment in this case truly is.

The change in government not only brought about corruption, nepotism, and outright abuse of public funds and offices to unprecedented levels, but it also brought back the days when appointments were based on relations, race, ethnicity, without any regards to merit and competence.

Laisani is both dumb and unhinged which is a dangerous combination. During the ODPP drunken scandal she defended the crooner Rabuku by saying he was a better singer than his critics, who were jealous of his voice. I kid you not. She actually said that. On social media! That’s how clueless, out of touch and shallow she is. One shudders to think that this is the caliber of people manning the ODPP. No wonder they can’t win any cases. Only good for drinking and partying.
These so called lawyers should undertake ethics courses every three months to refresh the knowledge of their roles and how they should behave. I do not believe any of them have undergone an ethics courses with the way they are behaving. I think being an iTaukei gives them the right and the entitlement to be arrogant and classless. Is that far from the truth?
And why do I read in places that some lawyers are members of the FLS and other are not or were former members. Isn’t every practicing lawyer supposed to be a member of a professional body or is it a choice in Fiji? Perhaps they do not have to comply with any code of ethics. I would not be surprised because we all know Fiji is a very special place.
Unfortunately, the 2006 coup that brought in Bai/Khaiyum transformed the Fiji Law Society into a “voluntary” social club – a ghostly shadow of its former self.
At least this proves there is yet hope for the dumb in Fiji. As long as the Coalition government remains, the dumb will always have a job.

The DPP spent more than $50,000 on legal bills to defend himself the first time and in the end, couldn’t afford to defend himself at the actual hearing, at which he was found not guilty even without being represented.
They are not reimbursing him even though he was exonerated and reinstated. Do you honestly think it is right to put him through the same ordeal again? And to get the same result? If Salesi Temo thought he could win, you can bet he would already have done it.

In a proper court, a judge’s job is to act as the referee, to rule on issues of law.
Why does not the ODPP take further action to pursue their “complaints/accusations”?

Actually, it’s the other way around. Accused are not required to prove they are innocent. The are innocent until proven guilty beyond reasonable doubt. That is why it is very concerning when there are maverick lawyers representing the State.
Andrea, it doesn’t take a rocket scientist to see how corrupt and incompetent the current Chief Justice is. He is not only abusing the authority as CJ, but actively supporting the Coalition his masters in targeting opposition members and those who supported them. His comments in court are well reported and when Magistrate Puamau gave a judgment in favor of Bainimarama, Temo was furious. He made his opinion and bias known and reprimanded the Magistrate and went to the extent of dictating what sentence should be given. In a true and fair democracy where the rule of law is upheld , there are proper mechanisms in place- but not with Temo.
As for Pryde, I don’t know what you are going on about but certainly you are factually incorrect. He hasn’t been charged with any offence. He has been found to have not done anything wrong by a Tribunal consisting of 3 judges. You now have an incompetent Acting DPP wanting to usurp the role of DPP and fabricated allegations against him – again.
Once the COI report is out, perhaps you will be better informed about the corrupt practices of the CJ and his other clowns.

The Fiji Times article today “Commission of inquiry counsel clears the air” is astonishing to say the least. The journalist actually calls out Mason for responding to questions put to her by journalists. This may be the first time that I have seen a news organisation calling out someone for speaking with them! An example of the questions: “Do you believe your ongoing statements respect Fiji’s legal and political sovereignty?”
What on earth? These “journalists” are so mired in their biases- and that of their news organisation- that they are not even pretending anymore!

If you are a ratepayer you can access newspapers etc on PressReader app via State library NSW for free. Check with your council library. Both FT and Fiji Sun is there. Good luck.

Fiji Times reporters asking Mason dumb and biased questions is not surprising because they are only following their trainer and leader, the one and only Stanley Ian Simpson. Read his comments on his Facebook page that follows. Clearly he has gone out to bat for Biman and Kamikamica. After all didn’t these two Minister gift Stanley $1.75m tax money to buy off his media company?

Various coalition partners, speaking in confidence, have expressed surprise and concern at some of the unilateral decisions being taken with some likening the process to be “in the style of Bainimarama and Sayed-Khaiyum.”
The complication however seems to be the implication of senior cabinet ministers in the COI report – with one, the AG already sacked from his position.
FICAC Commissioner Barbara Malimali has also been sacked – but for both her and Leung – no reasons were outlined or given except that it was due to the findings of the COI report – that they have not seen.
There is some concern amongst coalition members as to who is giving the PM and President advice – and the agenda they are pushing as some of the advice is flawed and questionable in their opinion, and designed to disrupt government. There is some alarm at what they see is the government turning on each other while the opposition watches and cheers
There is also concern as to why the PM is not sharing the COI report to give those allegedly implicated a chance to respond. They believe the COI is just full of allegations.
The PM has however said the report is not being released to avoid prejudicing ongoing or future investigations.
Opposition parties have cautiously praised and welcomed the PM and President’s decisions but say they have not gone far enough and must continue for good governance. FLP leader Chaudhry has urged the PM to “continue the clean up process,” while Usamate has accused the PM of selective justice.
Former AG Sayed-Khaiyum has however accused the PM of not adhering to the law and the Constitution, and hijacking the work of the COI. Sayed-Khaiyum says under the Fijian Constitution, it is only the Judicial Services Commission (JSC) that can advise the President on removing or suspending the Commissioner of FICAC.
The President has however stated he is empowered to act based on legal advice provided by Kings Counsel Phillip Joseph – who had been asked to provide the legal opinion by the COI.
The legal uncertainty and ambiquity continued yesterday when the President reviewed his decision and sacked Malimali, writing that the first letter suspending her was “sent to you in error.”
Today’s cabinet meeting may bring greater clarity to the situation but Fiji’s political and legal landscape remains tense as people await the next big bombshell.”

I have just read that Siromi Turaga has been appointed as the Acting A-G. He was demoted from that position last June 2024, presumably because he wasn’t up to it but now he has been brought in from the cold. Yup, can’t get any worse because Fiji is drifting into yet more uncharted waters!
