# YOUR LIFE IN THEIR HANDS. WHEN THE STATE KNOWS BETTER THAN YOUR OWN DOCTORS AND JUSTICE DOESN’T COME INTO IT

The rogue Chief Justice, Salesi Temo, will give his ruling on Friday on the application from Aiyaz Sayed-Khaiyum‘s lawyers to vary his bail conditions to allow him to receive urgent medical treatment overseas. And it speaks volumes about the state of the rule of law in Fiji that the result is a forgone conclusion. It will be denied.

Why? Because the Chief Justice now has before him a medical report by doctors working for the State that contradicts the recommendations from multiple doctors in the private sector who have attested that the former attorney general cannot obtain the care he needs in Fiji.

The latest medical report is being used by the Acting DPP, Nancy Tikoisuva, to argue that the government’s own doctors should be relied on when Justice Temo makes his decision and that the application should be denied.

Yet there is strong evidence that the government’s doctors may have been lent on. Why? Because as recently as April, one of them – cardologist Dr Sukafa Matanaicake – had provided the police with an official opinion that Aiyaz Sayed-Khaiyum’s heart is not normal and he needs treatment that isn’t available in Fiji. (see below).

Today, Grubsheet publishes the various medical opinions that would normally be confidential but that we are releasing in the public interest amid a welter of competing claims about just how sick Aiyaz Sayed-Khaiyum really is and whether it is necessary for him to be allowed to travel overseas.

The source of the following documents is NOT Aiyaz Sayed-Khaiyum – from whom Grubsheet is estranged and with whom I have had no contact whatsoever for more than five years. Nor are they from any member of his immediate or extended family or from members of his legal team. They come from sources deeply concerned that the medical warnings about the threat to his life are being ignored and that justice has been replaced by vindictiveness and a desire to punish.

Wild rumours have been circulating that Khaiyum isn’t sick at all and will use the opportunity to flee Fiji and escape the charge against him of abuse of office. Incredibly, the Acting DPP has questioned whether he has suffered a stroke at all. And the Chief’s Justice’s entire approach to this hearing has been one of scepticism.

Salesi Temo played medical expert by suggesting in open court that Aiyaz Sayed-Khaiyum seek treatment at Heart International, the local facility that the CJ said had successfully treated other patients. Well guess what, Fiji? He has. And the opinion of the experts at Heart International is unambiguous.

Here’s your chance, Fiji, to examine the evidence for yourself. At issue is the right of every Fijian to rely on the professional opinions of their own doctors and especially medical specialists in a particular field without being second guessed by “Big Brother” – the State.

It starts with the medical certificate provided to the court that gives the lie to the widespread and pernicious rumours that Aiyaz Sayed-Khaiyum is faking his illness.

Now here is the document the State is relying on to argue that Aiyaz Sayed-Khaiyum doesn’t (yet) need overseas treatment and his conditions can be managed locally.

You’ll see that one of those signatures is that of cardiologist Dr Sukafa Matanaicake, who has certainly had a change of heart in the three months since the following correspondence with the CID.

Dr Matanaicake said definitively then that Aiyaz Sayed-Khaiyum needed treatment that wasn’t available in Fiji. So what has happened to change her opinion?

FACT: Doctors at three separate medical facilities in Fiji – Aspen Medical, Health Masters Medical Centre and Heart International – concur with Dr Matanaicake’s original advice to the authorities, not her latest advice with two other state-employed specialists.

First Aspen Medical, where Aiyaz Sayed-Khaiyum has been treated for his stroke and heart condition.

From Health Masters Medical Centre in Nadi, this:

And finally the full correspondence from Heart International – the private hospital where the Chief Justice suggested that Aiyaz Sayed-Khaiyum go when he already had. And received the following unambiguous diagnosis that completely contradicts the State’s own doctors.

We are about to find out whether justice in Fiji is dispensed on the totality of the available evidence and not just from one source literally in the pocket of the State.

And in that sense, every Fijian is Aiyaz Sayed-Khaiyum. Because when the State is really determined to come after you, what your own doctors say doesn’t mean a damn thing.

Having taken Aiyaz Sayed-Khaiyum’s case for himself, the Chief Justice compounds his appearance of bias by seemingly being willing to play Russian roulette with the former attorney general’s life.

The fact that “Dr Temo” himself stands accused of abuse of office by the Supreme Court Commission of Inquiry – of perjury and obstructing and perverting the course of justice – is a supreme irony in itself under the circumstances. But to embark on a course of action that is persecution, not prosecution, is not justice and exemplifies the unethical approach the State has taken with this case from the beginning.

We have already seen the ODPP instructing the police to hound a patient on his sick bed by going to the hospital and demanding entry. Even a sworn enemy of Aiyaz Sayed-Khaiyum, lawyer Richard Naidu, criticised that. But If Aiyaz Sayed-Khaiyum loses his faculties or dies because he can’t get the right treatment, what are we as a nation going to tell his three young children about the quality of justice in Fiji?

In other news, there has been a rare sighting of the resurrected Minister for Bonking and Weed fully clothed on the nation’s screens – an appearance on “Bent Talk” with Vijay Narayan.

We’re hearing that Vijay’s limp line of questioning could have done with some of the stimulation for which the Strumpet of Room 233 is best known.

The Minister evidently told Vijay that her pornographic video was to reignite desire in her main man – the multimillionaire, Rob Semaan – from whom she is officially divorced for income declaration purposes yet to whom she remains very much married.

Of course, Soft Cock Vijay didn’t ask who was wielding the camera – reputedly the Strumpet’s visiting toy boy from the British Army.

    Aiyaz has made things more difficult for himself.
    1.His property is up for sale in Nadi.
    2.How urgent is his conditions.
    Almost a month now and his conditions hasn’t gone from bad to worse.
    His kicking around.
    3.He, himself brought in state of art Aspen into Fiji,now his looking to go overseas.
    Temo was correct to say he has heard some success story.
    4.Mr Arts of Fiji times was similar victim as ASK .
    Mr Arts presented everything he could, yet he wasn’t allowed to leave Fiji.
    An old person was begging court to grant him to leave Fiji .
    You be the judge if there is fairness here.

      I think we firstly should forget that its ASK. The question we should be asking ourselves is this. If I have confirmed written recommendations from a certified specialist that I am in need of immediate medical care that is not available in country. Should the state wield the supposed hammer of justice and pronounce me guilty without allowing me to defend myself by withholding approval for me to seek the needed care. Because if the Government can do this to him, then they can do this to us.

    I won’t be surprised if AsK is part owner or shareholder of Aspen Fiji.
    Anything is possible.
    All these doctors are saying ,this and that in favor.
    Why can’t these doctors do same for those poor patients who can’t even afford Panadol.
    There are so many very poor patients that need urgent overseas treatment.
    The poor one’s are for experimenting here.
    Rich are given referral to seek overseas treatment.

      The shareholders of Aspen are public records. Go and do a company search. Im sure you will find that Khaiyum is not a shareholder. He was definitely involved in the PPP agreement with Aspen in his capacity as Minister for Economy in the past government. That doesn’t make him a shareholder.

      Those referrals are the doctors professional opinion and im certain they are objective and based on facts compared to your wild unfounded allegations that he is a shareholder of Aspen and the doctors are favoring him.

      Can you please explain why you want the doctors to do overseas referrals for poor patients. These referrals are for people who can afford to pay for the overseas treatment.

      Please stop repeating everything you hear around the grog bowl from other uneducated non objective people. Learn to gather facts and not make wild accusations you cant substantiate.

      Its people like you who are making Fiji a racist and dumb place. Because you shoot your mouth off before thinking or learning the truth.

      And no, I am not a Khaiyum supporter. I detest the man for some things he has done, but that doesnt stop me from basing my views on truth and logic.

I’m sure you are the kind that believes that Aiyaz has lots of money stashed overseas and has lots of property all over the world and that he only wants to travel to be able to access his billions!!

      He is trying to sell his property cos he doesn’t have any finances to support his growing medical expenses and bank mortgage. He has been hounded and harassed for 3 years now and hasn’t had the opportunity to properly run his new law firm in order to support his young family.

      He has already traveled for medical attention and come back to face the courts. Why the f**k would he run away now? Who would he run to? His wife and children are here. His parents and siblings are here. His firm and his home is here. This is his country contrary to the forged police documents that stated he was a Bangladeshi national! The courts and the media didn’t even address this forged police document!
      If he and Frank have so much money stashed away then why would he sell his property and why would frank be fighting for his pension?

      He needs medical treatment by his doctors who know in detail about his condition and they are in Singapore. It’s very easy to understand this but everyone who is a racist and ethno nationalist like Temo and Rabaku are deliberately ignoring this and feigning ignorance. These people are racist corrupt clowns who will do anything to destroy Frank and Aiyaz. They are evil spawns of the devil and they need to die before Fiji can become free of their evil demonic presence.

    Legally, the weight of his clinical evidence (medical records) provided by his doctors should outweight any other consideration. The “clinical findings” are factual evidence favourable to AKS. Those are the facts. Unchallengable. These established facts were provided by a bunch of different medical professionals as evidence to corroborate AKS case for further medical treatments abroad.

    It would therefore be cruel by anyone to go against the clinical findings of the medical professionals and deny AKS the medical treatments he so urgently requires.

    Two of the 3 doctors in the panel who decided on behalf of ministry of health are not qualified on cardiology:

    Dr Sukafa Matanaicake
    • Primarily described as a Consultant Physician at CWMH, not explicitly titled “cardiologist”   .
    • Participated in advanced cardiac procedures and training with visiting interventional experts, but designation remains “Consultant Physician” .
    Conclusion: While deeply involved in cardiac care, she is not formally identified as a cardiologist—even if she manages cardiac conditions.

    Dr Luisa Cikamatana Rauto
    • Recognised as an Ophthalmologist, heading the Eye Clinic and serving as Acting Medical Superintendent or Chief Medical Advisor (Ministry of Health) .
    • No mention of cardiology training or practice.
    Conclusion: Not a cardiologist; her specialty is in ophthalmology, not cardiology.

    Pretty interesting to see the comments.

    I’m not a fan of ASK, but if he can afford to get medical treatment overseas—regardless of what’s available in Fiji—that’s his choice, and it should be allowed. If someone has the means to pay for it, it’s not really anyone else’s problem.

    Of course, there’s the question of whether he might return or not. A sensible approach could be to place some form of legal hold over two or three of his properties until he returns, to ensure accountability.

    And for those convinced he has shares in Aspen—let’s be real. The current government has spent more than a year digging for any dirt on the former PM and AG. If there was proof of that claim, it likely would have been revealed by now. These are the same kinds of claims as the old rumour that ASK owned the Fiji Airways planes.

    Aiyaz’s demise from non treatment will be on you – many believe what is happening to Aiyaz is karma for his perceived and alleged atrocities.     Temo and his enablers are not going to let him get the treatment that he needs and they will happily watch him die in the court room and proclaim that it was nothing to do with them, but it was God’s will. These are the people that go to church on Sunday and fool themselves into believing
    that they can do no wrong whilst committing crimes like this on a regular basis.

    They are all hypocrites and one can only hope they themselves suffer a similar debilitating event as a result of the way they are treating a sick person and denying him the treatment that he needs to survive.

    They are vindictive lowlifes who will stoop to any means possible to achieve their vicious intentions and do not deserve to walk on this earth.

    But hey, they must be right in their beliefs……….they are regular church attendees. So God will smile on them as they carry out their evil plans.

    Despicable is the best that can be said about them. Hopefully there is a Hell that has a place booked for them to spend eternity in.

    Before ASK came into limelight in 2007. No one knew who he was.
    Khaiyum name was around through his dad who was NFP politician and was managing CJ Singh’s assets.
    Many of ASK’s friends told us that before 2007 that he wouldn’t have much in his bank account.
    After 16 years of rule, he has properties all around Fiji.
    That’s very fast.
    There were no audits whatsoever.
    FICAC and FIRCA were greyhounds if you spoke against government and had business.
    Everything thing he controlled.
    Anyone who raised questions was shot straight away.
    Ask any questions, he had answers.
    But I do hope he gets well soon.

      I remember those Friday nights at O’Reilly’s and Traps bar, where Aiyaz would come in for drinks.
      Suuprising he was in work uniform with sulu walking around in a pub.
      Next I heard was he was controlling government.
      Was funny he was lecturing people twice his age, on how to run a business or do this and that.
      Journalist would be scared to ask him questions.
      No one knew he had qualifications of a lawyer as he was not in practice.
      Wow, all happening for this guy.

      People were bowing in front of him.

      Later he was called a king.

        Bob, that’s the most accurate description of that fellow. No right thinking person was willing to hire him with his law degree since 1999 upon his return from Australia where he had fled to after 1987. He even fled to Auckland to be at his brother’s place when he heard that the Australian navy task force was just offshore from Fiji, only returning to Fiji after the Aussie force left Fiji.He was assisted in going to see and offer his legal service to Bainimarama a week or two before 5th December 2006. As a lawyer for Colonial bank ,his boss was hounding him as one of the shadowy figures that were planning a coup. Out of fright he offered to be the Attorney general for a new coup government.
        Those are facts. He then was labelled BLUNDER BOY by everyone because of his wrong legal advice he would give to the military council.
        The only reason he became the satan in his later years on the job was because Qarase won the court case and This Blunder boy advised Voreqe to abrogate the constitution. Thereafter he became king and brought his mother’s younger sister Nur Bano and his idiotic younger brother , let’s call him VW TOUREG into the government machinery.
        The rest ,as they say is history. He even stole the party name FIJI FIRST from the displaced Muaniweni people, who had formed a party after the horrendous actions of George Speight and his group on them .

      Can you show us some proof that he owns properties all over Fiji. At least give us some addresses. We know you cant show us property titles. (which is the real proof of ownership).

      Or did you just pull this information out of your backside?

      I am not sure exactly what Khaiyum was earning during that time. Even if he was earning $150k a year and with all the perks they get, they would have a high disposable income. It would be easy for him to buy a property or two with the help of a bank mortgage.

      But he certainly doesn’t own properties all over Fiji.

      Stop spreading rubbish and go get yourself an education. Learn about critical thinking and cognitive skills.

      It will certainly improve your intelligence.

      If all is available in Fiji, then why did Rabuka travel to India to get his medical done ?

      Its just amazing how we have bush doctors who get qualification of reading few comments. These are same people who would be running around begging for money for overseas treatment if their loved once’s needs treatment .

      By no means i support ASK nor do i like him. However, one shouldn’t change law or bring in personal difference just because it suits them.

      Its pretty simple deal, send him for treatment and as a guarantee have 2 of his (multi million dollar) properties as bonds. And have his brother submit his passport.

    If he never got into politics, then he wouldn’t have been going through the hardships he’s facing now.

    They just want Aiyaz to be trapped in Fiji so that he dies and they can eliminate him.

    The absence of penal of doctors qualification do say many words. Most likely because of this many locals are dying young with heart conditions in Fiji. Thanks to private providers there is some relief to fortunate people who could afford. Also there were instances where unqualified doctors were operating in Fiji.

    How does an ophthalmologist become an acting medical superintendent? The same woman managed CWM Hospital and ran it to the ground. She should go back to being a mediocre ophthalmologist. Dengue fever and HIV are rampant; Mental health is a scourge; St Giles is bursting at the seams with youth. Polio and more viruses are approaching, and we now read that the woman ophthalmologist is now a cardiology assessor for the trial of the former minister for everything. How did she get there? What is the relationship between the permanent secretary of health and this woman? The permanent secretary, the woman in question (acting medical superintendent), and the health minister, who is the son of the president of Fiji, must all resign. They might handle a crisis at a tiny rural hospital, but not the problems facing the country. Christian anti-vaxxers bury their dead every week, and many of them are young. We should bring back Dr Fong, together with his trained doctors. During COVID, we were secure in Dr Fong’s leadership, vision, and decisiveness, which helped save lives. Rather, we have untrained i-Taukei kilavata physicians who merely collect pay cheques as the death toll rises.

      Principal qualification is you must be itaukei. Being from vanua levu is a bonus. Being from the eastern islands group is double bonus.

      No other criteria required.

    Majority Itaukei have already found ASK guilty of conspiracy theories that the Itaukei conjure and propagate from one kava session to the next.

    The fact remains that ASK hasn’t been found guilty of everything against him that is currently before the court.

    Sadly, Majority Itaukei are bigoted right wing Christian nationalists who walk around with a mouth full of scriptures and a heart full of hate.

    This is the fate that awaits every Fijian politician of Indian origin, that is very educated, is extremely articulate and dares to shake the status quo for the benefit of all. And it will be even more bitter to racists if the politician subscribes to the Islamic faith. This is the sad fact of things in Fiji now.

    The very maligned SALESI TEMO will set up the ASK conviction to cement ethno-nationalist sentiments rooted in chiefly rule to continue exercising executive overreach.

    Pray for Fiji.

    It seems that modern day politics in Fiji is increasingly driven by vindictiveness and revenge. While I do feel some sympathy for Aiyaz, it’s important to acknowledge that he was far from innocent in this regard. He was often ruthless towards those who opposed or disagreed with him during his time in government. That said, politics should be set aside when it comes to decisions about his medical treatment. Whether he should be allowed to travel overseas should be determined solely on the basis of his health, nothing else. His case is a significant one and if the DPP believes he may be exaggerating or faking his condition then the fair and transparent approach would be to work with the Defence lawyers to appoint three independent overseas medical experts agreed upon by both sides. Their collective assessment should determine the truth of his medical status. If they recommend that he needs overseas treatment, I see no issue with that and in my view, neither should the Court.

    Wonder why he returned from his multiple overseas trips back to the cesspit of vipers in Fiji. Unlike the majority of the bigots – who given half a chance of a USA visa would overstay in San Francisco Bay….or not return from anywhere abroad other than Tuvalu or PNG!

    Pointing fingers at Christian fundamentalism is good and fine and well deserved but let’s not forget that the Khaiyums’, including Aiyaz, Riaz and their Dad, are closet Islamists. Mohammed Saneem as well.

    Aiyaz removed Queens head from our currency and dispensed with national holiday for Prince Charles as he virulently anti British. It was a gift for his father, as reported by GrubSheet.

    They did not remove. The crown because of colonialism, as they claimed, but because of the perceived British anti- Muslim policies, such as in Iraq and Palestine.

    They deliberately detained Biman and sacked solicitor general Sharvanand Sharma on the most auspicious of Hindu Festivals, Deepawali, to show whose boss and demonstrate their contempt. Saneem played a major part in the latter. They were getting blatant, audacious and shameless by the day. Imagine another four years with them.

    Despite all this, we show should humanity at all times and follow the law. If Aiyaz needs overseas treatment as the medical report indicates, he should be allowed medical treatment, and given the benefit of the doubt, even at the risk of him taking flight.

    We should forgive, but never forget.

        There is a difference between ‘Islamist’ or ‘Islamism’ and ‘Muslim’. Look it up. They are not interchangeable.

        On second thought, perhaps they are!

        And the crusades were a reaction to the Islamist expansion and threat to Christian Europe and in part, to reclaim formerly Christian lands that had been conquered by Muslim forces.

        You should be thankful for the crusades.

      What I have seen is a lot of comments from people who call themselves Christians, but do not act like Christians. The comments are hateful, bigoted, racist and generally unpleasant.

      And some people have pointed that out.

      Nothing to do with Christian fundamentalism.

    There appears to be a whole heap of lamusonas in Fiji. From the PM and the pedo President to the CJ to everyone else in government. I think 90% of fake Christians pretending to be Jews are also afraid of ASK. There is a level of fear from a sickly man. The whole population seems to be bunch of cowards. There are many Hindus in the same boat. They have a fear of Muslims. It is hilarious. I guess they are not praying hard enough.

      The fundamentalism, hate, and violence of Hindus in India toward minority faiths is well known.

      There is no difference between natives here and Hindus and Muslim fundamentalism. Same for ‘christian evangelical Trumpers in the South and across the mid-West.
      Trumpers aren’t exactly friends to any group, including the people of Israel. They reserve a special brand of hate for the Jewish people.

      There is even less different amongst gold rolex Rabaku and Modi and Orban, Natenyahoo, and Putin and the Orange blob.

      Hate and bigotry are hate and bigotry in any faith and any language.

      The native Fijians tho, have refined hate and bigotry to a fine art.

    The current fiasco in the judiciary are legitimate reasons for insurrection when all parts of the state are totally against the principles of Justice and Fairness and Equality before the law.
