# FASTEN YOUR SELT BELTS, FIJI. MAJOR TURBULENCE AHEAD

As expected, Sitiveni Rabuka’s handpicked Acting Chief Justice, Salesi Temo, has reversed the acquittals of Frank Bainimarama and Sitiveni Qiliho on an application by his handpicked illegal Acting DPP, John Rabuku.

So what do we expect to happen, Fiji? You tell me. Because on March 28 on present indications, Frank Bainimarama and Sitiveni Qiliho are going to jail.

    Such a sad state of affairs – not surprising though. They made sure they had an outcome desirable to them.
    Funny they said Aiyaz controlled Judiciary – what about this lot?
    Rambo a coupist who bankrupted NBF is pardoned and in the driver’s seat overlooking many wrongs of his Govt and here we are.

    With the obvious bias of the initial magistrate, illegal appointment of the Acting DPP and hand selected Acting Chief Justice – none of us have any clue as to the guilt or otherwise in this high profile case. Indeed, in any cases of law now, we are now all clueless. Yes we may have our opinions, but there is no objective testing of evidence and fair process for any of us to know the truth.

    A military man never goes to jail in banana republic like Fiji and Pakistan. They can try. I want to see when the plans of the current regime go pear shape and the guys in green take the current AG to the barracks in nabua and give him a touch up like they gave the rebel soldiers. That will take his cunning smile of his face.

    How will Pio Tikoduadua and Police Commissioner Juki Fong clean up the police when the top brass are full of liars and failed and convicted lawyers. That includes the PM and his ministers, the Acting DPP, some judges, the Chief Registrar and a dodgy AG. Fiji is fast becoming a failed state. Expect nothing less when the leader is a crackpot and a well known despot. I am sure many are exuberant with the state of affairs in this Third World country.

    The PM carries immunity.
    About time women of Fiji band together and take him through international courts for the part he played in violence.

    The judgment isnt legally binding.

    Rabuku is disqualifed as per the constitution to hold the role of the DPP – this has been stated so many times

    Today’s decision should make anyone who’s had a case dismissed in the past be very afraid.

    This is a a result of the high standards practiced in the Fiji judiaciary, starting with the Chief Justice. Democracy is alive and well in Fiji. The Fijii government and the Fiji judiaciary including the AG are all God-fearing people. This is all God’s doing.
    I am sure whatever happens in the near future will be God’s doing as well.
    The people of Fiji are truly blessed.

      Section 117 (2) states “The Director of Public Prosecutions must be a person who is qualified to be appointed as a Judge.”

      Section 105 (2b) states the following relating to the appointment of judges: “…has not been found guilty of any disciplinary proceeding involving legal practitioners whether in Fiji or abroad, including any proceeding by the Independent Legal Services Commission or any proceeding under the law governing legal practitioners, barristers and solicitors prior to the establishment of the Independent Legal Services Commission.”

      What hgh standards are you referring to?

      The only thing high is Tabuya with her weed.

        At least the AG and the CJ and the PM and that woman and the coalition partners think they are setting “High Standards”.

        I have on occasion wondered if the Fiji Law Society has backed off challenging these appointments because of the wording of the constitution. Both of these positions are “Acting” which may be constitutionally unclear. It could possibly be argued that the intention is there for acting positions as well, but this lacks clarity.

    I doubt FB will go to jail. Obviously he can still appeal. But it clears the way for a snap election with FB ineligible.

    This is so ridiculous and tiresome. They all rewrite the “rule” book to suit their own objectives.

    I say throw them all in jail together.

    It’s all so grubby (pardon the pun).

    The Insitutions DPP and the Judiciary are not individuals. However, The Acting CJ and The Acting DPP are individuals who occupy these offices. The work these individuals do is not of private/personal nature. Anything they do, the Institution is responsible. It matters not how they get appointed or what qualifications they have. Just my simple analysis. It’s a vicious cycle we are in today. It will continue in perpetuity whoever comes to power.

      An institutions’ integrity and transparency comes from the individuals who legally hold such public offices. It does not operate in a vacuum, but based on fair and equal justice for all admindtered under the law by individual officers. Ask any investor and they will say a fair and impartial judicial system is required to protect investments through the courts. Run by individuals. No integrity, no trust in the system, fewer investments, fewer jobs creation. When the judiciary is peopled by trust-fund abusing miscreants who are not eligible for such postitions, then we have a problem.

    A truly sad day for Fiji. To put behind bars the man who literally saved the country from disaster in 2000 and again in 2006. If it wasn’t for Frank, Fiji would have been a failed state long ago. No doubt the tables will turn again some day (hopefully not too far into the future!)

    What goes around comes around ! The law of karma . Frank allowed the former PM Qarase to be thrown in prison ! He set the precedent ! Now it’s his turn ! Next 2 years someone will throw Rabuka into jail too you watch !

    Can these men advance this country because sure as hell many of us are tired. Absolutely had enough. They drag each other to court while kids are living in poverty in this country.

    Imagine waking up in Australia tomorrow. A PM gets dragged through the courts every time a new Government comes in.

    Fiji it is time to get rid of all coup leaders. Just tell them to get out with your votes. No more military men should be allowed anywhere. Vote wisely.

    We have to kill this culture.
