It beggars belief that before the Ashton-Lewis Commission of Inquiry into the appointment of Barbara Malimali as FICAC Commissioner delivers its long-awaited report, Malimali should choose to “clear” the Deputy Prime Minister and NFP leader, Biman Prasad, of wrongdoing when his case was examined by the COI.
It is a travesty of justice that again raises serious questions about the integrity of both Barbara Malimali and Biman Prasad. But more importantly about the institutional integrity of FICAC itself. Because whatever the merits of the case against Prasad, the timing of this announcement is all wrong.
Why? Simply because we know that Justice David Ashton Lewis has examined FICAC’s handling of the complaint against the Deputy Prime Minister. He will have brought all of his forensic ability as a senior judge to examining precisely what happened. So what on earth has motivated Barbara Malimali to pre-empt any finding the COI might make on her handling of the case by publicly clearing Biman Prasad of wrongdoing?
It doesn’t take a legal genius to smell the biggest of rats. On any reasoned appraisal, the FICAC Commissioner should have awaited the findings of the Commission of Inquiry. Instead she has taken it upon herself to declare Biman Prasad innocent irrespective of what Justice David Ashton-Lewis might find. That doesn’t smell of due process but a stitch-up. And it simply increases the stench around both Malimali and Prasad, who continues to face a police investigation into allegations made against him.
As Grubsheet understands it, the position is this: FICAC has chosen to reject a complaint against the Deputy Prime Minister by the Sydney-based amateur sleuth and watchdog, Alexandra Forwood. But it ignores a much more detailed set of allegations by the Oxford-based Victor Lal at Fijileaks.
Evidently at official urging, Victor Lal has taken his evidence direct to the Fiji Police. Barbara Malimali must know that Biman Prasad is now under police investigation. Yet she has still chosen to publicly clear him while that investigation proceeds. And, again, before there can be an official judicial pronouncement from David Ashton-Lewis about whether Malimali has properly handled the allegations made to FICAC about Biman Prasad’s conduct.
So never mind the allegations themselves. The process itself stinks to high heaven and merely raises further public suspicion about the integrity of the FICAC Commissioner. Something is very rotten in the state of Fiji when a judicial inquiry can be pre-empted in this manner and on the say-so of the very person under investigation – Barbara Malimali, in her case by the Judge – clearing someone else who is also under active investigation – Biman Prasad, in his case by the police.
The NFP leader undoubtedly believes he is off the hook. Yet whatever the next twist in this saga, Barbara Malimali has merely succeeded in raising further questions about Biman Prasad’s conduct and putting him under more pressure. Instead of spraying the sweet scent of innocence around him, there is now a bigger stench around both of them. Because all this has happened before Justice David Ashton-Lewis has spoken.
Victor Lal is right. Keep running, Biman, because you are not in the clear. Far from it. And whatever happens with the allegations against you, you will be running all the way to election day and then you are going to be crash-tackled. Because in the court of public opinion, you are already toast. (see below)

But while Barbara Malimali might have loosened the noose around Biman Prasad’s neck – for the moment – he is already swinging in the court of public opinion.
An article in both dailies today by the academic, Sushil Sharma, supporting changes to the Constitution also contains a devastating indictment of the performance of the Coalition.
Here’s the relevant extract, which tells us a rendezvous with the public hangman is already Biman Prasad’s eventual fate come election day.

It’s very simple GD. The corrupt cabal has got whiff of the COI report. They realize that the report will either be eventually released or most probably be leaked. They most importantly got wind that the report is scathing of Barbara Malasikas illegal appointment and all the corruption surrounding the complaints and allegations against Biman and all his fellow corrupt coalition govt ministers. So they quickly sprung into action and in record time made an “official” finding that Biman is innocent of everything he is accused of and it’s also hinted that others will also be found innocent.
This is just a very dubious and messy way to pre-empt public opinion once the scathing COI report comes out. Rabuka, Malimali and others will say, “oh, yes we realise the report is scathing and critical of ficac and everyone involved and that biman should have been charged “then” at the time of Barbara’s appointment, but you see since then we have thoroughly investigated allegations against him and have found him innocent..so u see there’s nothing to be done against him now despite the scathing report.”
Something similar to this statement will be released next week once the report starts making the rounds. The compliant whores that make up the media will not ask any hard questions and will run with the statement without asking any follow up questions. Then the public will be expected to accept this explanation and all will be well for biman and any other minsiter that had allegations at FICAC.
Yaaaaaay! Everyone is happy. Rabaku will say “I can’t do much cos FICAC is independent” and Biman will laugh and laugh and laugh….and poke out his slimy tongue. And Barbara will continue with her job. Happy people all around. Kaila!!!
The only good thing you could say about all of that, is that in ‘a normal country’ when Malimali is found guilty by the commission of inquiry, then what she has done for Prasad, in letting him off scot free, would be overturned and he would be back in the spotlight for the raft of crimes committed.
To just mention the superannuation in her winding up of the charges against him and leave out all of the other parts requiring investigation is to, again, remodel the case to appear a simple affair of misunderstanding.
We all know that is not true.
Biman’s fate is sealed. He can’t point to a single policy action that has made a life-altering positive impact on the lives of ordinary Fijians since getting into government. His legacy will be that he betrayed people who voted to him. I am starting to believe that Japanese lady who reported against him pre-election. He is an untrustworthy, cunning and self-serving hypocrite drunk on power. If experience is the ultimate teacher, then Biman will learn soon that you do not abuse the power the people lent you.

The appointment of Udit Narayan and Neelesh Goundar was clear nepotism and one can’t help but wonder what the connection or motive behind the appointments may be. Is there a business deal cooking somewhere behind-the-scenes? It’s a fair question to ask .
The appointment of lawyer Richard Naidu to the Fiscal Review Committee was also highly suspicious, but it now makes sense because it paved the way for the vat hike to 15% and the undue concession to Fiji water. Vat was raised to compensate for things like the Fiji water tax concession, the salary increase of the MPs and other largesses of this government under its hopeless Finance Minister.
Further concessions to the likes of Tappoos reek of favoritism , if not corruption and these actions of the finance minister cemented the NFP’s reputation as a party for the elites.
Promising ordinary people a price reduction in lamb chops, and increasing minimum wage of our desperately poor people by a pittance, while granting hundreds of millions in concessions to a few elite businesses. If that’s not corruption and bad governance then what is?
No wonder he is referred to as the worst finance minister in the history of Fiji. His nickname ‘Baimaan’ is well earned.
As time goes by it is getting ever clearer that all the CHOR of the coalition government are in one boat and all in coalition are CHOR, including those appointed to public offices without any independent due process.
Biman must clearly know now that his political career is going to end come elections. Rabuka and others like Lynda may yet survive due to the fact that half the itaukei are uneducated about facts and vote with thier knees.
What remains to be seen is how much can these guys make before the end of this current term in government and how much further can Fijians sink in poverty before they realize maybe Rabuka and Biman are self serving pieces of shit.
How is this possible when COI had earlier requested for Barbie M² to be suspended or they opted to accept her to be on leave until the report got finalised? Biman was in Sydney for Easter Holidays and was saying that people don’t understand Fijian politics as he had nothing to do with Pio’s 42 day overseas vacation. It was Rabuka’s call!!!

Culture, Health, Education, Work, Housing, Security ( personnel, national ) all in decline as stated and articulated by persons qualified and backed by data. I agree based on my observations and experience and since I have lived quite a few years more than the majority of the population I have a good baseline to draw on.
Take 1987 as a baseline. Those born in 1987 are now 38 years old, they have never been exposed to what Fiji was prior to 1987. Take 15 year olds, not yet adults, hardly aware of national politics and economics at the time, are now 53 year olds, 2 years away from retirement, representing 85% ? of the population.
I think parliament is in fact at this time holding hearings and receiving submissions to make law for Section 121 of the Constitution which is for a Transparency and Accountability Commission.
This section was in response to mine ( 1 of 2) and 6800 other submissions of a total 7,000 submissions to the Ghai Commission on substandard government services. I suggested District Guardian Councils. The Ghai Commission gave us Sec 121 T&A Commission, which, if Parliament decides, can empower the T&A to in fact set up District Guardian Councils or more technically call District Transparency and Accountability Commission Committees. I prefer and like Guardian Councils.
I any event, my second submission was for a “One Party State”, in which the above suggested Guardian Councils would hold the Party to account.
The present $100 million dollars spent on elections once every year would fund the One Party State committees and structure at $25 million per year. Give it 16 year, 4 election cycles I suggested, time to implement and induce some civic pride and discipline and provide ownership in the administration and governance of our country to the people.
How bad could it get, compared to the Sh*t we are subject to every day of the week under this system we have that is in collapse before our every eyes.
Well the Ghai Commission must have thought there was merit in my submission. They sat there, gobsmacked, like stunned mullets. I know when somebody is in agreement with me.
They could not declare Fiji, a One Party State, so they set up a Constitutional Assembly, a body to consider, no doubt, haha, my submission for a One Party State.

The Minister of Itaukei Affairs is somehow correct in his context as a itaukei Minister to encourage them to move out of poverty given their land & sea resources. But what he should be doing is to go down to the root of the problem of the itaukei people in terms of their wealth vs resources:
1. The majority of the itaukei people 70% doesn’t have the modern brains or the skill to till his/her LOUs own land and become an entrepreneur…they lack the business mind to bring together the concept of “solesolevaki” for their respective LOUs to modernize it to meet the existing business concepts;
2. This 70% itaukei people are left behind in the business environment (mostly in the remote rural areas of Viti-levu, Vanua Levu and the Maritime islands), due to non-existence of infrastructures, utilities, communication technology to support their land resources development. However, they enjoy this type of livelihood due to their beliefs and faiths in the Living God Yahweh in these last days event. They are content with what they have in accordance to the bible, but does not mean that they cannot reap more from their land resources due to the non-existence of services that should be provided by the central government (mentioned above);
3. The 70% of the indigenous Fijians have relied on their TK (Traditional Knowledge) to survive on their land & sea resources over the last 3,000 years and sustain them…it is the respective ministry like the itaukei ministry, itaukei trust fund and TLTB should come down to them and capacity build them, fund them and provide the necessary infrastructure development to enhance their capability in developing, managing their resources.
4. Good Governance and Transparency is the name of the game, whereby the minister of itaukei affairs should be advocating to the itaukei people in running their business especially when their businesses are connected to their land and iqoliqoli resources. Not much has been done in this crunch area of business, as a result most itaukei business (especially small individual entrepreneurship) have failed over the years.
5. Fairness of financial support to this 70% itaukei are missing and no wonder they are the poorest people in Fiji but with rich land & sea resources – the other 30% itaukei who are largely the elite itaukei have the advantages of financial support due to good credit rating, know how (well educated maybe), skills, social status as high chief or Ratu…this is what the itaukei minister should be addressing to ensure that the gap between the rich itaukei and the poor itaukei are eliminated and not purely blaming the 70% for being unproductive;
6. This 70% iatukei people should learn to work hard on their land & iqoliqoli resources using their TK and their faith in the Living God Yahweh, they should grasp the principles of hard working in their bible and live the talk – less day dreaming, end all uneconomical social gatherings but more resources channeled towards their God-Given land & iqoliqoli resources so they become economical productive and Spiritual healthy to the Living God Yahweh
7. GCC, TLTB and itaukei Ministry should not only protect their tangible & intangible land & iqoilqoli resources but empower them to develop and manage their own resources sustainably and if they cannot, then lease or joint-venture investment them to others to bring in the much needed wealth to their respective LOUs and to the nation;
8. All LOUs should learn to work closely with TLTB, & NLC in the development of their land & iqoliqoli resources rather then trying to be isolation with these two institutions. These two institutions are governed by the LAW, NLTA 1940 and the iTaukei Lands & Fisheries Commission (TLFC) is a statutory body constituted under the iTaukei Lands Act 1905 and the Fisheries Act 1941 to adjudicate on disputes regarding land ownership, fishing rights and customary chiefly position. These two institutions are basically the custodianships of all land & iqoliqoli resources in Fiji under the LAW and cannot be changed unless the indigenous Fijians (ALL LOUs) want them to be changed…this can be regarded by many disgruntled LOUs as the barrier to “development wealth” of the itaukei people …but one must remember the backgrounds of the TLTB 1940 and NLFC 1941 before reforming these two LAWS that have been holding the fort of protection on the interest of the itaukei people over the last 151 years…LET THEM (4,400 + registered LOUs ) decide what is best for them and how they should be governed…who are we to decide for them??…Remember the Kleptocracy regime of FB & AK tried that for the last 16 years under the disguise of AK’s sunset clause thesis but was never succeed …if the majority of the indigenous Fijians wanted to remain poor economically until the return of Jesus Christ let it be, its their choice …as a Christian I believe in good health, strong faith in Him, resourceful, follow His Commandments, and a good stewardship of land & iqoliqoli resources but does not mean I am restricted from becoming wealthier in the land resources that have been allocated to my ancestral during the 1928 Lands Commission in Fiji (Veitarogi Vanua 28.10.1928)…it depends on me and my family members (Vuvale/Tokatoka/Mataqali/Yavusa) to decide the best way forward to develop and manage our resources in the next 50 years or so and we look at TLTB, itaukei Affairs, Itaukei Investment Fund to design the best way forward to sustain these two important resources, and if not then REFORM these two institutions BUT has to come from the indigenous Fijian people and the GCC, NOT THE GOVERNMENT OR ANY POLITICIAN for that matter!!
9. The indigenous Fijians are some of the loving people of this plant earth and the good minister should factor that in encouraging them to have joint business venture with others here in Fiji like our indo-Fijians brothers on land resources. You combine them they will compliment each other in terms of their resources that could bring enormous wealth to their respective “Vuvale” and eliminate economic poverty…
10. The minister knows there’s no one else left to blame. Some “Vulagi” have left fiji in numbers due to the political upheavals of 1987 (twice), 2000, 2006. Most are still actually work the land. He can either blame himself and his government or he can blame the itaukei. In both cases he is right. The challenge is us the itaukei or the indigenous Fijians today (4,400 + LOUs members or 62% itaukei people), GCC, itaukei Affairs ministry, itaukei trust Fund and TLTB:
“ASK NOT WHAT YOUR LAND & IQOLIQOLI RESOURCES CAN DO FOR YOU, BUT ASK YOURSELF AS AN INDIVIDUAL MEMBER OF YOUR RESPECTIVE LOU, AND AS A CITIZEN-FIJIAN, WHAT YOU CAN DO FOR YOUR LAND & IQOLIQOLI RESOURCES TO BRING BOUT WEALTH, LOVE, AND STABILITY TO THIS NATION WE CALLED VITI”.
