Since when has it been acceptable in Fiji for a notorious Deputy DPP who was removed from the top job because of his professional misconduct to contradict the elected Prime Minister? Since a few hours ago when John Rabuku made a fool of Sitiveni Rabuka by saying on Facebook that the PM’s plan to hold an inquiry into the “rotten” circumstances surrounding the appointment of Barbara Malimali as FICAC Commissioner simply cannot happen.
Can anyone seriously imagine a deputy DPP in the Mara era telling Ratu Sir Kamisese Mara in public that a course of action he planned couldn’t happen and suggesting that he was stupid? Can anyone imagine a deputy DPP in the Bainimarama era telling Frank Bainimarama in public the same thing? Of course not. But this is now the level of arrogance that is being displayed by John Rabuku that demonstrates beyond doubt that he is unfit to hold any office in the ODPP – that he would publicly challenge the elected Prime Minister.
It doesn’t matter whether John Rabuku is right or wrong. As a matter of fact, he is technically right. The only way to challenge the decision by the Judicial Services Commission headed by the Acting Chief Justice, Salesi Temo, to appoint Barbara Malimali to FICAC is by judicial review through the courts. But that is beside the point. Anything Rabuku has to say about anything should be said behind the scenes, not in the full glare of social media.
It is absolutely astonishing that someone who has been removed as Acting DPP after he was unlawfully appointed by the mad outlaw Temo should have the gall and basic lack of respect to make a Facebook posting depicting the nation’s leader as an ignorant fool.
If Sitiveni Rabuka has any balls, he should demand the immediate sacking of John Rabuku as Deputy DPP for publicly humiliating him and bringing him into disrepute with the Fijian people. Salesi Temo and his coterie of inappropriate appointments are now beyond arrogant. They think they run the country, not our elected representatives, And it is time that they are disabused of the notion and proper respect is afforded to those who subject themselves to the electoral process, not those who owe their positions to nepotism by their kai vata and mates.
John Rabuku is way out of line. And for the Prime Minister to leave him in place after such a gross act of disrespect will tell us all that he has completely lost control of the state and is unfit himself to lead the nation. Breathtaking.

A complete contradiction and challenge to the Prime Minister’s statements in the media yesterday. Who the hell does John Rabuku think he is?

Why does John Rabuku think he can get away with such an outrageous act of insubordination? Because he and his equally miserable boss, Nancy Tikoisuva – the Acting DPP – are close friends of Barbara Malimali. And they all think that their relationship with the Acting Chief Justice means that they can say what they like about Sitiveni Rabuka and anything that comes out of his mouth.
It is high time for the whole cabal to be smashed and replaced with proper professionals who understand their place and say whatever they have to say behind the scenes without humiliating the head of government.
Grubsheet doesn’t have much time for Sitiveni Rabuka personally but this is totally beside the point. It is the office of Prime Minister that is worthy of respect. And John Rabuku has just given that office his middle finger.

Rabuka got it wrong once again. Accept it and ‘move on’ !
Don’t people realise that Rabuku wants to be relevant. Alternatively, those at the JSC have sucked him in to do the dirty work for them. Most likely it is both.
John Rabuku is not only a hypocrite but a dickhead.
The very Constitution he is now saying should be upheld, he shamelessly breached by accepting the Acting DPP position not long ago. He knew fully well that he did not qualify and should not have accepted that position because of his convictions under the Constitution. It appears the Constitution only applies selectively depending on who it affects and when and the circumstances at the time depending on what outcome one wants to achieve.
The sad part is John Rabuku did not know he is a dickhead, until I just told him.
How many more such people are there in the judiciary and in government in Fiji?
With idiots like him in positions in which they are in, Fiji will remain a proud Third World nation. These are essential characteristics in any proud Third World nation and any such nation needs people like Rabuku – proud idiots.
It is not surprising he got sacked from DPPs office during the Bainimara era as well as a second time more recently Hopefully third time lucky and he is permanently sacked ,never to disgrace the DPPs office again.
Does anyone have a working brain in the coalition and its appointments.

My (English jurisprudence) is a little rusty; but there are two elements of these two cases that are troubling. The first is the Malimali case, as has been widely reported that this matter is before the police and therefore it has become de jure and the law will take its course to the criminal investigation of the relationship between Malimali and the FICAC. Therefore, legally, the (police investigation) will have PRECEDENT over any other inquiry or such like. Their finding of facts could determine the outcome of the shenanighans at the FICAC et al.
The second concerns Rabuku. If he has been found guilty by three superior court judges of a potentially serious “professional” misconduct which is likely to diminish confidence in the legal profession or bring into disrepute his standing as a practicing barrister/solicitor than it is the duty the Bar Council of Fiji to take action against him. They (the Bar Council) could do that on their own volition. If his conduct constitutes a serious breach then he could be struck-off from the rolls of the register or his practice certificate withdrawn or suspended.
The same could also apply to Malimali’s case, because she too is member of the Bar Council of Fiji and there are professional “conduct” issues complaints against her. Any member of public could report them to the Bar Council and they will carry out their own investigations against these two recalcitrants. But it appears that the Bar Council of Fiji remains silent – rather bizarre!
There is NO Bar Council in Fiji. There is the Fiji Law Society representing the lawyers in private practice and that’s it.
It is a matter of grave concern that the Law Society has said absolutely nothing about the “rotten” events at FICAC. Nor has it said anything about the disgraceful injustice being meted out to the suspended DPP, Christopher Pryde.
It seems they are part of the problem rather than being part of any solution.
So who doesn’t know what he’s doing now? If the Prime Minister was wrong in law to call for an inquiry then who is his chief legal advisor?
Graham Leung, the AG, needs to explain himself. His silence is deafening.

Interesting all the comments about Graham Leung. He is only interested in the AG title that’s all, so he could proudly put it in his CV and apply for his next job.
