The rogue Chief Justice, Salesi Temo, has refused an application by Aiyaz Sayed–Khaiyum, to recuse himself from the trial of the former attorney general and that of his co-accused, Mohammed Saneem, despite being demonstrably unfit to judge the case.
It will come as no surprise to anyone that Salesi Temo has refused to budge because he clearly took the case himself to convict Aiyaz Sayed-Khaiyum and his former supervisor of elections irrespective of the evidence against them and send them to jail.
No-one in Fiji can have any confidence that the judiciary is independent when we have a corrupt oaf like Salesi Temo at its pinnacle who willfully defies all accepted convention to exclude himself from a trial when there is such glaring evidence of bias. And he has the temerity to cast it as being in the public interest, with the astonishing comment that the taxpayers of Fiji “pay him to work, not sit on his backside”.
No, you bastard. The Fijian people pay you to dispense justice without fear or favour. And instead you have corrupted our most important institution and reduced it to the status of kangaroo courts in some third world hell-hole.
This is a man who has been accused of perjury and obstructing and perverting the course of justice by the Ashton-Lewis Supreme Court Commission of Inquiry into the Malimali afffair. Temo should have been stood down long ago by the Prime Minister advising the President to suspend him but is being kept in place precisely to jail their collective political opponents whatever the evidence against them.
Reports are emerging that at the most recent meeting of the Constitutional Offices Commission, the Prime Minister told those present that he wanted Salesi Temo removed. But he was reportedly told an uncomfortable truth – that the COC has no role in suspending the Chief Justice. It is the Prime Minister who must do so by advising the President to suspend him.
But Sitiveni Rabuka refuses to do so because the President, Ratu Naiqama Lalabalavu, is his chief and the forelock-tugger who pretends to governs us feels he cannot defy the accused pedophile and convicted treasonist he installed as our Head of State. And the President won’t remove Temo because he is an old friend and a relative by marriage. It would be a national joke if it wasn’t so shocking and the implications so grave.
The entire system is corrupt. So in the absence of Temo’s removal, this is all we can do, Fiji. Refuse to acknowledge him as Chief Justice and refuse to acknowledge any of his judgments, including that against Aiyaz Sayed-Khaiyum and Mohammed Saneem. They deserved a fair trial and they are not going to get it.
The law in Fiji is genuinely an ass. But worse, there is no longer justice in our courts. Because in the case of the Chief Justice, he has been found liable of serious criminal offences by a legally-constituted Supreme Court Commission of Inquiry yet remains in place to pass judgment on others. And that is a scandal unprecedented in Fijian history.
Shame, Temo, shame. And shame on Sitiveni Rabuka for not having the guts to remove him and restore public confidence in the judicial system, which is the very foundation of our democracy and our most precious defence as citizens – the rule of law, not the rule of the jungle.

The Chief Justice says he will give his reasons after the trial. But it is he who is now on trial in the court of public opinion, including his miserable patrons – the Prime Minister and the pedophile and treasonous President who are keeping him in place.

But I thought Khaiyum suffered a stroke as there were lots of hue and hype regarding his medical. On a closer look today he looked perfectly fine, was walking properly and joking around the court.

FYI- some people can have s heart condition where the heart does not beat at a regular pace- arrhythmia, these can lead to blood stagnation in the heart with potential small clots being thrown into circulation and the brain resulting on what’s called TIA’ Or a mini stroke or precursor to a major stroke. If this heart beat is not corrected, of course there is a very real threat that a major stroke may ensure. Does Fiji have cardiac electro- physiologist, doctors who are tasked with correcting irregular heart beat, inserting pacemakers and monitoring the after care of these pacemakers ? The answer is NO, hence, although I do not really understand Aiyaz’s condution, from the media and court accounts, it appears that he suffers from Atrial fibrillation, a heart arrthymia with recompensed cardiac output, potentially severely increasing the risk of a severe stroke and cardiac death.
Can a person walk, talk, smile normally after a stroke? Yes certainly possible. If the stroke happens to be in a less critical area of the brain, then these functions can be preserved, this does not mean the person has not had any stroke. Moreover, if the extent of damage from brain blood clots, or less commonly from brain bleeds, is small, a lot of bodily functions can be preserved. However, this situation can be a ticking time bomb with potential to turn nasty , hence the need for specialist medical intervention which is – once again , and to correct the CJ- Is Not available locally.
Please refrain from judging someone by the books, how they dress, smile or walk, in my experience, spanning over 30 years- these are the people who are the worst off ploughing through their grief and medical illness . Lest we hope this medical situation does not occur in us or our loved ones, its very easy to sit and throw stones. Please, as human beings, have words of kindness and empathy and Support for anyone, Anyone, who requires medical care , especially if such care is not available or not on par with international standards locally.

🚨 BREAKING: Temo Says Naidu Still Convicted 🚨
CJ Salesi Temo today declared in court that Richard Naidu’s conviction for contempt still stands.
Temo said another High Court judge had no jurisdiction to later set aside the guilty ruling — the only option was for Naidu to appeal to a higher court.
This directly challenges last year’s decision by Justice Goundar, who dismissed the case and cleared Naidu.
What does this mean for Naidu’s legal standing — is he still a convicted man? 🤔
BTW . Temo the head of the fijian judiciary told the court today in front of a group of eager journalists that the “fijian judiciary is backwards”.

If Justice Temo in this case gave a verdict of Not Guilty and acquitted ASK, the most seemingly unlikely judge to give such a verdict – there would still be people saying ASK is guilty. Cardiac and Neuro conditions beyond medical specialists to cure.

In light of these ongoing unethical, illegitimate and unprofessional developments, it will be interesting (as Editor Fred would say) to observe the premier gathering of the country’s legal professionals in Nadi next month.
Will the FLS have new office bearers including the replacement of its forever silent and compromised President?
Will their dialogue cover the role of private lawyers and FLS in a deteriorating situation such as in Fiji, specifically with the rule of law, DPP, Police and drugs, COI, the butter thief case study etc? After all, ethics is key to the legal profession just as the rogue CJ ceremoniously lectures at each admission of lawyers to the Bar.
Fiji often claims, very very proudly so, its regional leadership role in all aspects of life. The Ocean of Peace initiative endorsed last week in Honiara is the most recent in that regard. So representatives from the Pasefika Lawyer’s Collective to also attend the FLS convention will have loads to learn (and unlearn) about Justice Fiji Style. That will be real professional development – a key convention objective.
And of course, let’s not rule out the piss ups, karaoke, in the aftermath led by the hosts, Nancy, John et al.
The Pacifika lawyers’ collective will be there to grease and massage local lawyers’ hurt/injured/bruised egos and balls.
Pacifika people across different professions tend to circle the wagons to protect their own from “foreign” judges’ calling out short comings and skirt lawyering.
The good local lawyers don’t have the balls to openly oppose the intrenched stink and corruption within their own fraternity for fear of upsetting the apple cart.
The good local lawyers – as much as that sounds like an oxymoron – are busy making money before they move abroad for ‘greener’ pastures.
