The Fiji Sun carries a front page story today reporting that the DPP, Christopher Pryde, is continuing to be paid despite being absent from Fiji for more than 100 days after being cleared of misbehaviour and reinstated.
FACT: The Judicial Services Commission headed by the man who falsely branded Pryde a thief – the Chief Justice, Salesi Temo – asked the DPP to respond to allegedly fresh allegations of financial misconduct that were recycled from the original file considered by three High Court judges headed by Justice Anare Tuilevuka that were rejected.
FACT: Within a week of receiving the first of these allegations, Christopher Pryde responded to them saying they were false.
FACT: When he did so, the Chief Justice sent him further allegations of misconduct which Christopher Pryde also responded to promptly, again saying they were false.
FACT: The DPP has asked the Chief Justice to assure him that he will not be suspended for a second time for misconduct before he returns to Suva to resume his position. He spent the best part of two years suspended over the charges of misconduct of which he was eventually cleared and is understandably anxious not to repeat the ordeal.
FACT: The Chief Justice has so far refused to give Christopher Pryde that assurance. In the meantime, he appointed Pryde’s accuser, Nancy Tikoisuva, as Acting DPP in Pryde’ absence.
FACT: Christopher Pryde, as DPP, has sent repeated correspondence to Justice Temo and the Attorney General, Graham Leung, asking them about the progress of the JSC deliberations on his case and has not received a response.
FACT: It is this refusal to respond to Pryde’s correspondence that is delaying his return to Fiji and in the meantime, he is being paid his salary that was restored by presidential order after Salesi Temo suspended it eight months before the Tribunal hearing at which he was cleared.
FACT: The ball is in the court of the JSC, not the DPP. And today’s story is fundamentally flawed in suggesting that he is being “paid to do nothing” when he has always indicated that he will return to Fiji as DPP as soon as the JSC rules on whether he is to be suspended again for misbehaviour.

A second Fiji Sun story on the reappointment of Laisani Tabuakuro as an Assistant DPP is also a travesty of the facts.
FACT: Laisani Tabuakuro was on probation as an ADPP and when Christopher Pryde was cleared and reappointed, he decided not to confirm her in a substantial position.
FACT: During her probationary period, Laisani Tabuakuro, issued a statement criticising the Fiji Labour Party in direct contravention of ODPP policy that the Office is above politics.
FACT: During her probationary period, Laisani Tabuakuro, made statements in court that were inflammatory and discourteous, including during the trials of Frank Bainimarama and Sitiveni Qiliho.
FACT: During her probationary period, Laisani Tabuakuro sent correspondence to all staff at the ODPP criticising Christopher Pryde.
FACT: Tabuakuro was not confirmed as an Assistant DPP because she had brought the ODPP into disrepute.
FACT: She has now been reinstated by the Acting DPP, Nancy Tikoisuva, in an extraordinary act of nepotism that ignores the gross misconduct that resulted in her not being confirmed.

Laisani, it is astonishing that you would think it appropriate to respond to what I have written in the way that you have.
You are an Assistant DPP. Yet you are behaving as if you are a private citizen with no obligation to the position you occupy.
It is proof conclusive of the correctness of the DPP’s decision not to confirm you in your position. And the fact that Nancy Tikoisuva has reappointed you is an appalling indictment of how low standards have fallen at the ODPP in Christopher Pryde’s absence.
In fact, it leaves me wondering whether you are completely all there. God bless you too. You certainly need his/her help.
Ha, Graham, a few months ago, John Rabuku responded to a comment I made on FB on a private citizen’s post re JB position in the ODPP but it was inappropriate given his role. In those circumstances and similarly here, one would not respond even in their private capacity. This again is evidence that these people do not understand the obligations of their role. This response from an assistant DPP are reportable and action should be taken but then again we all know there is no rule of law in Fiji.

Herein lies the problem of appointing people to positions based on their ethnic background and who you know rather than on merit.
The whole civil service now should now be called the civil non-service. It is the direct result of rewarding mediocrity.
Everyday we read of some catastrophe due to civil servants not performing their duties. No drugs in hospitals, no passports at immigration department etc.
The latest being the unpaid teachers.
How much more fundamental can this get? Some people are getting paid every fortnight to ensure these teachers also get paid. Alas it doesnt happen.
And I do not believe it’s due to lack of finance. Because we still see a lot of dark tinted luxury vehicles been driven around on our roads at speeds much faster than they should.

Her comments exhibit a remarkable lack of judgement and a complete lack of decorum usually shown by those in the legal profession. Particularly one who is employed by the ODPP who are subject to very defined codes of conduct.
